John Lewis forgot to charge me!

So I moved 10 months ago. About that time I ordered about £1000 from JL online and paid with my debit card. They delivered all items except one and no information was forthcoming about the last item. I assumed I was debited for what they did deliver (yes, not very good at watching my bank statements!)

So a few weeks ago they emailed me acknowledged their omission and were "delighted" to inform me that I wouldnt be charged for the missing item.

The NEXT DAY I was emailed asking to settle the balance.

Now I am happy to settle the balance for goods I accepted - I am just a bit peeved at this level of service - they basically screwed up an order and forgot to complete things on their end. Now, nearly a year later they want me to pay.

Do I have any rights to ask for a concession? I had assumed I had been billed (and I have now checked, I wasnt) - now things are more difficult for me to pay and I feel messed around.

    They have up to 6 years to charge your card, be grateful they did it after only one ;)
  • Nope no rights, you owe and you pay. They have upto 6years to recover the payment

    Stay polite. Inform them that your current ability to pay is limited but was fine at the time of purchase. Their demand at this time (due to THEIR error) will cause you financial hardship, so you wish to agree a repayment plan to cover the outstanding debt; for example £250 per month for 4 months (interest free).

    That's the approach I would take.

    I don't believe you. There's no way someone who by their own admission is struggling a little financially wouldn't notice an extra £1000 in their account. It's a lot of money to simply miscalculate.

    And as already said you have no rights to a discount although they'd likely agree to a payment plan.

    If you owe you will have to pay once they have claimed it but you could try sending them a some slightly less than £1k together with a note to say that you have deducted ,say, £40 because of their poor service. Enough to make you feel a bit better, not enough to make it worthwhile for them to pursue it. Mind you if you want to order from them again this might be a dangerous game to play.

    Quiet the opposite, if they were to go to court they potentially could ask for interest to be added.

    In theory you've also had a concession, you've had 10 months interest free credit from them!

    You can't unilaterally decide not to pay the whole amount, as that would be theft.

    No exactly no. Card auths are invalid after 6 months. Which means they'd have to recharge your card. They can't actually just do that, it would be unauthorised.

    However as it's clearly a significant, outstanding debt, and John Lewis clearly want their money back. They have 6 years to claim it via the courts.

    So op, I'd just work out a payment plan with them, you don't want fees, and debt collectors fees or a CCJ going on this amount too.

    A court won't reduce the debt because you're feeling wronged. It'll just go up with costs. I reckon they'll think you're having a laugh....didn't know £1000 didn't go out.....

    I think visi meant be thankful they didnt come knocking for the k aftyer the 5 or in the 6th year by which time the products would be probably end of life or not appear to be worth what they once were
