TESCO, 2 Self Edge Labels SEL for same product

Hi All,
Can anyone say if:
1) It is against "the law" to take a photograph of a SEL in a Tesco Store (as opposed to against Tesco policy / rules)
2) If there is two SEL's for the same product quite far away from each other is it "double the difference"?
The product has a market value of £5.98, and the two SELs were £6 and £8.
After suggesting that it might help if I contacted Trading Standards I was paid double the difference.
The argument from the Store was that it was not "double the difference" (Tesco's own policy) because at least one label displayed the correct price!
And by extension, actually there was no overcharge either.
The two £2 payments to me, £4, being therefore goodwill!
Welcome any comments for next time!
Many thanks, Jerry

What determines it's market value?
What did it scan at? Not quite sure what the fuss is.0 -

If it was against the law, then there would be a lot of MSE members getting their collars felt by plod, as shots of Tesco SELs make a regular appearance here in MSEland....2) If there is two SEL's for the same product quite far away from each other is it "double the difference"?...
That would be up to Tesco. I'd certainly give it a go.I was paid double the difference.
There you go. Result.0 -
As far as I am aware...
There is no specific law against taking a photograph (another example would be of a school performance, say) HOWEVER on private property the property owner does have the right to apply rules and to have you removed from the property should you fail to comply.Don't put it DOWN; put it AWAY"I would like more sisters, that the taking out of one, might not leave such stillness" Emily DickinsonJanice 1964-2016
Thank you Honey Bear0 -

If you were charged the correct price (and that is equal to or less than the SEL price) then DtD wouldn't apply, that's only for overcharging not undercharging. And what is market price? The till price?0

As their double the difference policy is in addition to your legal rights*, they can put terms like that in it. So, as I think you recognise there, you have done pretty well out of it
*your legal rights are next to none, Tesco can just refuse to sell it to youSquirrel! If I tell you who I work for, I'm not allowed to help you. If I don't say, then I can help you with questions and fixing products. Regardless, there's still no secret EU law.
Now 20% cooler0 -

Store is talking rubbish.
In this case, it should be processed as an overcharge with Dual Location entered on the system as the reason code. DTD absolutely applies in this case, don't let them tell you any different, and insist it's recorded on the CSD.
The reason stores don't like recording things as overcharges is because one of the store targets is the number of overcharges per 10,000 customers.
If the store tries to get difficult, insist they record a customer complaint on CSD with a reply from head office required. If they don't want to do that, then write/ phone the central Tesco number (Not the store number from the top of your reciept), and more than likely they'll get a visit from the area manager

Thanks everyone + gollom007. Just to conclude and be clear...
They sold me the product at £8 that was offered to me at SEL of £6. A simple £2 overcharge. But about 7 metres away, on the opposite side of the isle, the same product was SEL £8.
So the Customer Service Desk argued the £6 SEL did not count because the product was displayed at the "correct" price elsewhere in the store. I said that the correct price was £6.
After reading your replies I checked with the Council and The Price Marking Order 2004 requires SEL price to be "close" to the product. So there is a potential £5000 fine for TESCO.
They blagged it. So I most certainly will be writing to HQ in Chestnut and hoping for a voucher in return.
If market traders pulled that stunt there would be chaos.
She also blagged about the law and I agree there's no criminal offence taking a photo in TESCO. It's a store policy.
The same product is sold by The Post Office for £5.97. So £8 is a rip off price anyway.
Many thanks0 -
If you knew it was cheaper elsewhere, then why buy in the more expensive shop?
Also, what do you want the compensation "voucher" for? Is that fir your distress?1. Have you tried to Google the answer?
2. If you were in the other person's shoes, how would you react?
3. Do you want a quick answer or better understanding?0
