VAT receipt on restaurant takeaway

Hi,
When I was working away last month, I got a takeaway from a restaurant. I asked for a VAT receipt (to claim expenses) but was told I could only get a VAT receipt if I ate in the restaurant (so they are VAT registered), not on takeaway. I was only able to get the Credit Card slip. My company says they can not bill this on to the client I'm working at without some form of receipt (VAT or not) (so don't go back).
I was wondering however what the legality of this is? Isn't the takeaway (hot food) still vatable and a VAT receipt should be given?

If OPs employer is only able to bill on to the client with a valid receipt then a per diem allowance will not be the answer.0 -

Many thanks. It looks clear that the restaurant HAS to add VAT to any hot takeaway food.
The question is though, if that's the case are they obliged to provide a VAT receipt? I would have thought so as I'm (in theory at least) paying the VAT.
Can't get a per diem as we're operating within client guidelines that are specific amounts and we have to receipt everything. Other clients have been per diem which is much easier.0 -

They are not obliged to give a VAT receipt if they're not registered. If for example they run the take away as a separate, non VAT registered business, then they would be unable to provide a VAT receipt.0

If their their turnover is less than £79k they don't have to be VAT registered so won't have to give a VAT receipt.Accept your past without regret, handle your present with confidence and face your future without fear0 -

That's why I mentioned they are vat registered.0
