Bank Charges Question - So close before!

So I tried to reclaim my bank charges a few years ago and had my 'court date' set. 4 days (!!!) before this date, I had a letter come through saying all claims had been put on hold while the OFT investigated - which resulted in all claims being void.

My question is, I think I still have a claim but where do I (re)start?

The banks won the court case, so there is nothing for you to re-start that the Bank will have to consider.

According to this site, it is still possible if you contact the Ombudsman?

Can you find any success stories on the forum?

Banks now only consider requests for refunds of charges if you currently meet the criteria for "hardship" and then typically for charges during the last six months.

Requests for refunds of historical charges will be refused and the Ombudsman will not over turn such a refusal.

You've missed the boat (by several years) I'm afraid.

Fair enough, but I think this site might need updating then :)

    Hardly, the advice about Bank Charge reclaiming begins thus;
"Rumours of the death of bank charge reclaiming are greatly exaggerated. People still regularly get some of their excess charges back – adding up to £100s, joining the £1bn already repaid.

Yet reclaiming the up-to-£35 a pop charges for breaching your overdraft is now primarily for those in financial hardship. This is a step-by-step guide to doing just that, including free template letters."

There is nothing about claiming back historical charges...

The FOS will not consider claims that you have started legal action against.

I've no idea why you think that, but there is no point posting it on the open forums - MSE staff don't generally read the posts here.

There's a special email address to inform the folks at MSE Towers of links/articles that need to be updated. :)

Such a shame, thanks for your help :o
  • I have not claimed before and tried to claim my bank charges with HSBC, but they have said "the charges were properly applied and the outcome of the legal proceedings confirms our position"

Do I have any hope in claiming these charges back or do I give up now :(

As already said on this thread, the banks won the court case.

Nowadays, the banks only refund goodwill gestures. i.e. first time mistake or those in serious financial hardship.
