Payment to PPI claims company help!

Hi,
I was contacted by a claims company and started a PPI claim on an Egg loan i had from 2005-2008.
My claim was successful and i received a cheque for £4084 and £1414 commission was paid to the company in April 2011 as a full and final settlement of my claim!
In May 2012 (13 months later),out of the blue i recieved a letter from Egg saying due to a new court ruling my compensation had been re assessed and i was receiving a further cheque in the sum of £4487.
Around 2-3 weeks later i started receiving calls and letters from the claim company saying i owed them another £1450 because of this extra payment.
I told them i was not paying this fee as the extra payment came directly from Egg,not through them, and they had done nothing and that i only got this extra payment because of the court ruling!
Basically i heard nothing for months and then more letters and now the small claims court for the above amount.
Has anyone else encountered the same problem or has anyone got any advice as to my chances in small claims court!
Thanks.

You agreed to pay a proportion of any redress won from this complaint to the claims company. It's a legal contract and you cannot simply refuse to pay. Go to court with this and you could end up paying the other side's costs, having CCJ and still having to pay what you owe to the Claims Company.stevepb101 wrote: »In May 2012 (13 months later),out of the blue i recieved a letter from Egg saying due to a new court ruling my compensation had been re assessed and i was receiving a further cheque in the sum of £4487.

Inevitable outcome. Claims companies are vigorous at getting their money.Has anyone else encountered the same problem or has anyone got any advice as to my chances in small claims court!
You get compensation because you used them to put a stamp on your complaint rather than put the stamp on it yourself. The second payment only came about because of that complaint. Seems an open and shut case against you.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. You appointed them to handle the complaint. They were successful in what they set out to do and as it happens Egg are paying out extra. Your agreement with the CMC was to pay them a percentage.
I'm not sure how you have a hope in hell in winning in a small claims court.
Lets be honest, you received the extra money and hoped to hide it from the company YOU appointed to win it for you!0 -
The claims company did nothing for the extra payment though, that came directly to me from Egg due to the court ruling.0

But presumably there would have been no earlier payment if the claims company hadn't acted under your instruction and made the claim to Egg?
Therefore, any subsequent court ruling and further payment amounts have occurred as a consequence of the original claim.
Sorry, OP, I do think that the claims company are entitled to their percentage in this case.
Best of luck anyway.0 -

It came through because of the complaint made originally.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. Yes, right from the off they did nothing you couldn't have done yourself and for free.stevepb101 wrote: »The claims company did nothing
You've signed a legally-binding contract with these people to pay them a percentage of any redress won. No amount of wriggling will set you free from this and going to court is likely to cost you a whole lot more.
You'll have to pay them, I'm afraid.0 -
Will they have to produce the original contract signed by me agreeing to pay them a percentage of any and all future monies i receive?
The second payment was only made a year later due to a new court ruling and my original payment to them said in full and final settlement of my claim.
So if i get another payment in say 3 years time would i still have to pay them another percentage payment, and so on?0 -

yes. Although the chances of that are highly unlikely.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. I have now received the documents the company will use in the small claims court. There is an agreement signed by me on 3-9-2010 agreeing for them to apply for compensation on my behalf but no mention of any further payments on any future monies received by myself.0
