ParkingEye slated in the press

A while ago I posted a report on a court case where two ladies won at Southampton against PE, after getting assistance from Pepipoo. This was the one where PE's advocate tried to claim that the photos of the signs had been taken in November, when there were images of people in shorts, and shop signs saying "summer sale" in the background.

The Southampton Echo has now run a story on this (they used the F word, but all journalists seem to do that): http://www.dailyecho.co.uk/news/10989714.Hundreds_could_get_parking_refunds_after_women_s_fight/?ref=var_0 highlighting the fact that PE had no contract with the landowner when these charges were issued, which means that anyone who paid up during the relevant period has a case to reclaim their money. (Yes, it's The Range, again).

The DVLA has, as usual, been quick to take (in)decisive action: “The Driver and Vehicle Licensing Agency (DVLA) is investigating the matter, and says it may not release vehicle keeper details to ParkingEye if Chris and Sue’s suspicions are founded.”

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx.     Very interesting if the DVLA do rescind their rights, however I bet capita would suddenly ask for permission so keeping continuity.

    Other Capita divisions have direct DVLA links ( Equita for example ) so I doubt it will stop PE.

    I hope Capita are proud to have bought a company that demonstrably uses underhand and downright dishonest tactics, verging on breaking the law (if not actually doing so), and whose lies and totally unethical behaviour is increasingly coming to light in the courts.


    That sentence was meant to be ironic. However, Capita being Capita, they probably are proud to have acquired such a bunch of sharks.

    The Range, Aldi, morrisons, Welcome Break, and anyone else who has parking eye, or any other PPC on their land being forced to re pay customers who have been conned into paying the fake charges in a simalar vein the to PPI repayment scandal would be a good result.


    Having Capita loose access to the DVLA database as a result of Parking Eyes antics would be be the cherry on the cake, it may cause issues for local authorities, but then again they could always bring ticket issuing etc back in house.

    In addition, Rachel Ledson (PE's solicitor) has been reported several times to the Solicitors Regulation Authority for the way she and her comapny have acted.

    If they did have their electronic access rescinded, another division of Capita could not make an enquiry on their behalf, and it would soon become very obvious if they did.

    I wish I shared your confidence in the DVLA's ability and willingness to police and audit their own system.

    If PE access is revoked ( and that is a very big if ) then watch how quickly Capita collapse Parking Eye into Equita. Equita do the tax disk checking for DVLA and as such the operations could be merged together fairly easily.
