A very good piece. I do not think that we should quibble about the "F" word, it is far more emotive than "unsolicited invoice". I have no doubt that there will be a lot of very stroppy people in Southampton causing PE a lot of aggro asking for their money back

And now a follow up article in the Echo, suggesting top government ministers will look at the whole issue of data release: http://www.dailyecho.co.uk/news/10997361.Government_wade_in_after_parking_ticket_victory/?ref=twtrec

DVLA spokesperson in still hiding behind AOS figleaf shocker ...

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Now won't ParkingEye be popular with their compadres if things go completely bits up as a result of their avaricious and totally disproportionate use of the small claims process.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Strange that the previous incumbent of the Secretary of State for Transport didn't have the guts to deal with the issue despite it being pointed out to him in black and white. Oh, silly me, that would have been the liar Norman Baker !!!!!

DVLA spokesperson in still hiding behind AOS figleaf shocker ...

    ........
A spokesman for the DVLA said the organisation “took its responsibility to protect information seriously”.
He added: “That is why information is only provided under strict controls to parking firms who meet the standards set by an appropriate accredited trade association and are compliant with its code of practice.”
It's about time that questions were raised regarding the BPA's failure to ensure their members abide by the COP. The BPA are not fit for purpose and repeatedly just excuse all members behaviour and non-compliance as "technical" or oversight. Hardly ever are sanction points issued and certainly never to Parking Eye who repeatedly fail to abide, including the numerous times they try and withhold issuing a POPLA code.

Perhaps this is the time to introduce the influence that Parking Eye may have over the BPA - apart from being the biggest member bringing in the highest in membership fees/AOS IAS payments

Company records show that the BPA borrowed £80,000 from a bank however in their Annual report (page 7) it is shown as thus:

    http://www.britishparking.co.uk/write/Documents/Annual%20Reports/BPA_Annual_Report_2013.pdf
    .....

member bond deposits £ 80,131 - as falling due within one year

this suggests that a member or members have lent money to the BPA.

There are only a couple with the financial ability to do this - namely Parking Eye - with VCS/Excel possibly another contender.

The BPA's articles of Association also permit that they can borrow money from their members at an appropriate rate of interest.

Not forgetting of course that the one of the current Vice President's is Steven Brown of Equita and will be be President in 2015

The Range, Aldi, morrisons, Welcome Break, and anyone else who has parking eye, or any other PPC on their land being forced to re pay customers who have been conned into paying the fake charges in a simalar vein the to PPI repayment scandal would be a good result.
    Plus 8% interest :D
PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue.
  • He also wants to know what checks the DVLA carry out on firms before selling data.
We all know the answer to that one is "none at all."

A spokesman for the DVLA said the organisation “took its responsibility to protect information seriously”.
I'd like to know who that anonymous spokesman is, because he is an out-and-out liar. The DVLA dole out personal information with reckless abandon.

Maybe one of the more knowledgeable regulars can know up a template letter that everyone can either C&P or amend slightly and send to their MP.

If every MP gets multiply letters of complaint, they can't ignore it.

You have to remember that the BPA limited are not in any way a regulator, they are a trade association and the code of practice/AOS scheme is little more than a sop to the DVLA to make the BPA sound respectable in order for their members to access data from the DVLA.
Their sole purpose is to represent the interests of their members.
    From the Plain Language Commission:

"The BPA has surely become one of the most socially dangerous organisations in the UK"
