The company I work for employs a parking enforcement company - how to challenge

I wonder if someone could give me some advice...

The company I work for owns private land with a car park for which we operate from along with 3 other companies. A couple of years ago we employed a private parking enforcement company, Vehicle Control Services, to operate the car park for us (as we were getting visitors to the nearby football ground parking on the land).

Vehicle Control Services appear to come when they choose and a couple of weeks ago and today, have left parking charge notices on some employees cars.

They had valid permits, however unfortunately they did not have them displayed correctly in their car windscreens which is why the notices were left.

I just wondered if anyone knew whether, as we are the owners of the land and car park and we basically employ Vehicle Control Services to operate the car park for us, it was our companies discretion as to whether the charge notices left should be cancelled or not.

I have challenged with Vehicle Control Services but they won't cancel the charges and I just wondered if anyone could give me any advice on whether it is up to us, as owners of the car park, so say whether they should be cancelled or not.

    This is an easy one to resolve. As you are a bonefide employee of the Company who owns the land just get them to have VCS cancel the tickets! Job done.

    correct, the landowner has a contract with the PPC and the landowner should have a clause in that contract stipulating that they can cancel tickets as and when they see fit, there may be a limit on the number cancelled, but as you are the landowners then I would say you have overall control and its you not them that take anyone to court, so you are unlikely to take yourselves to court

    somebody in your firm should have the overriding authority to cancel tickets, so get them to read the contract with VCS and get them to tell VCS to cancel , otherwise its going to look silly when you write yourselves letters to send to popla insisting the tickets were cancelled by your company (the landowner)

    remember that you are dealing with thickos at VCS here ;)
  • The fuller answer is that your company will have a contract with VCS. Assuming you are in authority at your company and want to sort this out, not that you are just someone querying it...

    If you are fed up of VCS and they are not helpful to the company, check what is required to terminate the contract.

    Secondly, the contract should state what happens if you want tickets revoked. Ask to see the contract.

    Thirdly, if they play silly B's then you should note that they can only charge for actual loses incurred. As these are employee cars, authorised to park, then there has been no loss to your company. It would be trivial to appeal these tickets on the basis of the unfair charge (explained in great detail). Pointing out to VCS that if they won't cancel them, then the company will assist the employees getting these tickets rejected at appeal as demonstrated at the MSE site should convince them it is not worth bothering with.

    In nearly all cases, these contracts are flawed so they cannot claim successfully, so they usually want to keep the contracts hidden. As an employee you have an advantage over most if you can access the contract.

    Speak with the VCS sales team not the numbers on the PCNs. You will have this, or someone will whoever arranged for the contract in the first place. The chances are you will be limited to the number of cancellations or possibly won't have any.

    Is it actually your company that employed VCS or is it that you're on a business park and the management facility has arranged the contract?

    Put a notice on the Noticeboard to tell everyone with a VCS ticket to go here, read it and appeal as keeper (not driver) and it is NOT about 'permits'!!:

    I think it would be hilarious if they went to court and the judge asked who the plaintiff is and the VCS legal eagle says "me your honour" , then the judge asks who is the defendant and the landowner says , "me your honour, and I am also the landowner and wish all charges be dismissed as the plaintiff has no locus standi!" :D

    Maybe the company are getting an earner from the tickets. If that is the case, why would they want to get them cancelled?

    Is it really that difficult to display a permit?

    Did you not see that? That could mean they were upside down or simply in the wrong half of the windscreen.
    I suggest you take your ppc blinkers off and maybe you could then see the world around you.
