Late serving of Parking Charge Notice

On Saturday (1st Feb 2014) I received a Parking Charge Notice from Vehicle Control Services Ltd for allegedly stopping in a no stopping area of John Lennon Airport. This offence is supposed to have occurred on the 31st August 2013 (just over 5 month earlier), being new to this what action do I take (Help Please)

    presumably you are the RK and its a postal ntk (so POFA 2012 cannot apply now) , so DO NOT tell them who the driver is and appeal it as RK to get a popla code, then beat them at popla

    Sorry should have mentioned I am not the registered keeper, that is my wife but it was so long ago we have no idea as to who was driving at the time

    that is why you dont admit who the driver was, its completely failed POFA 2012 so only the driver is liable for the charge, not the RK , hence it would win at popla on that alone (ie:- chase the driver , not me , and I am not telling you who it was , lol)

    relevant land , not a gpeol , no contract , bad signage, all is in play with airports

    see this similar popla appeal for VCS at humberside that won at popla with similar circumstances

    but what you need to do is deny the charge asap using a suitable worded RK appeal to VCS first, to hook a popla code if they dont cancel

    and there are dozens of airport appeal letters on here , including page 1 of that thread I linked you to , so use the search function tool to find similar ones and plagiarise them for yourself or adapt that one instead
  • If the RK does not name the driver is there any credibility in the paragraph on the PCN

    "IMPORTANT NOTE - If you are the RK of the vehicle but were not the driver when the contravention occurred and you do not disclose the drivers name along with a serviceable address of the driver within 28 days of the issue date of this Notice, the vehicle keeper may/will be liable for the Parking Charge under the Protection of Freedoms Act 2012 (effective 1st October 2012)"

    Nope the POFA2012 does not apply on Airport land, and CERTAINLY would not apply if VCS have sent out a Notice to keeper five months after the event (they had 14 days!!). You will find all this covered in other VCS Airport threads on here already, just do a search for keywords 'VCS Airport'. The appeal has to be written by the registered keeper, not saying who was driving of course - as shown in the linked 'NEWBIES read this first' FAQs sticky thread.

    my replies and the last reply told you it cannot be used under POFA 2012 due to the length of time and so on, so as we both said its important that you use those facts as appeal points

    do not assume that what they are telling you is factual and beyond reproach , they have a vested interest in parting you from your cash so are hardly going to be truthful about these matters

    is short , you will have to appeal asap, you may have to appeal to popla , you will win at popla using the correct wordings I linked you to, that is then end of story
