Hi folks ive done a little research on how to handle this ticket and before I appealed I wondered if you could check my email to them.

This is my intended appeal to VCS, please advise thanks.

"Dear Sir

PCN XXXXXXXXXX.
Reg XXXXXXX

On the 10/11/2013 . The vehicle registered XXXXXXX (of which I am the registered keeper) stopped for 60 seconds at Humberside Airport.

Today I received a notice for "allegedly breaching the terms and conditions of the use of the Privately Operated Access Roads at Humberside Airport".

No contract was knowingly entered and no losses have been demonstrated.

The driver wasn't aware of restrictions in the area until pausing and reading the sign which instantly prompted the driver to drive away.

The driver took 60 seconds to stop read the sign then act on the signs advice, the driver suffers from Dyslexia and this would've contributed to the time to read.

I am aware you don't own the land and so I will require sight of your authority from the landowner to pursue payments.

In the circumstances I expect you to cancel this charge. If you refuse to do so, then you must send me a verification code in order for me to appeal to POPLA.

    It will do for this stage to get a POPLA appeal, that's fine - but remove your name from the draft you have shown here as this is a public forum and PPCs read it. Also remove the implication in your post above as to who was driving (in your introduction above). At POPLA stage there will be more you can add about no keeper liability at Airports and no landowner contract, etc. plus more details about the signage not being suitable for a supposed no stopping zone, and more stuff about 'no genuine pre-estimate of loss'. But we can help you with that when you've got your POPLA code.

  • just received the auto-mated reply from VCS which basically says:

    Be advised – WE ARE UNABLE TO PROCESS YOUR APPEAL/CHALLENGE WITHOUT THE PROVISION OF THE ABOVE REQUESTED INFORMATION – A PARKING NOTICE SERIAL NUMBER AND THE FULL NAME AND ADDRESS OF THE MOTORIST.

    I gave them the PCN and Registration......I this a stumbling block?

    If they don't get the driver name/address they won't process the appeal.

    But presumably you gave the keeper's name and address so that's fine. If not add the address of course but you do not have to name the driver. DON'T!

  • I assumed because they had sent me this notice via the post they know the keeper address lol :D I know they are trying to trick me in to giving the driver up just wondered if this was a legal stumbling block they can use to defend themselves later down the line :)

    I would follow the email with a postal appeal and get a free certificate of posting.

    VCS are on shaky ground with these charges because they are attempting to use POFA, yet its not a parking charge. Maybe the reason they would like the drivers details.
  • Do Not name the motorist.

    Complain to DVLA and BPA Ltd that they are asking for this information.

    Tell them if they are refusing to give a POPLA code that is their choice but they must pursue the driver. (Who they don't know!)

    Because PPCs have got litigious and because we win at POPLA which costs them money. No-brainer. :)
