VCS are on shaky ground with these charges because they are attempting to use POFA, yet its not a parking charge. Maybe the reason they would like the drivers details.
Also, most airports' roads are not "Relevant Land" as far as POFA is concerned - another reason they can't pursue the keeper.
  • Hi folks and seasons greetings!

I have received the letter telling me they have rejected my reason and want £60 off me buy the 24th of Dec.

They have sent a POPLA appeal form too.

You need to start drafting your POPLA appeal. For help on this you need to look at the NEWBIES sticky (which includes a 'How to win at POPLA' section), and the POPLA Decisions sticky (reading from the most recent rather than from the first decision as the most recent ones contain the latest POPLA thinking/interpretation).

Just so you focus on the key appeal points as you read through, these are the most effective ones in drafting a winning appeal:

    1. No genuine pre-estimate of loss (GPEOL)
    2. Signage
    3. No Contract with landowner
    4. Trespass
    5. Unlawful Penalty Charge
    6. Business Rates
    7. ANPR Accuracy

Don't forget to let us see your draft for advice on fine tuning before getting it off to POPLA.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

They replied by post marked 9th of December.

    Thanks, Dave.

" Hi Dave , I am very sorry to hear about this, I can imagine it is very frustrating. However, we are the travel shop based at the airport, and have nothing at all to do with parking , or parking enforcements. If you want to call us on 01652xxxxxx , we can try our best to direct you to the correct place or the right person that you need to talk to. Kind regards , Humberside Airport Travel."
