  • I am beginning to get somewhere, I found a telecoms solicitor who is willing to take the case on because he thinks according to consumer law, Vodafone needs to be able to prove that they provided the goods and services they are charging me for. Furthermore, faulty SIM cards are not uncommon occurrence.

    Will keep you all posted. I would really love this to go public when I can prove that Vodafone's billing system is a sham

    This is a point i keep trying to make on these forums when people complain about contract issues/bogus charges etc. It is up to the provider to prove that you have a contract with them and that you actually used what they are billing you for. A common example is when at upgrade time they dont give you what they promised to on the phone, then they cant provide you with the recording to prove you are right. If you just tell them you want to cancel and stop paying they will trash your credit rating but they wont take you to court as they cant actually prove you have a contract with them.

    I assume you are looking at taking them to court as they will NEVER take you to court about it. They will simply trash your credit rating and get a debt collection agency to send you lots of nasty letters. I think the reason they do this rather than get a proper court judgment is that they know in a lot of these cases they wouldnt stand a chance of actually proving any debt exists.

    As to your usage - why not look at your pad and check what it reports as your WiFi and cellular activity. This will confirm what has been transferred.

    Saying you cannot have used it whilst sleeping or at other times is nonsense - only when YOU turn off data will service stop. Apps will update silently, adverts from 'free' apps will refresh in the background and you may never even view them as they are refreshed regularly.

    You agreed to service, and to pay bills on request - the billing system is robust and certified by OFCOM, the ombudsman does not enter into billing disputes and never has done.

    If you want to slash and burn, then doing nothing is the way forward.

    Vodafone sad it was 'browsing', didn't they?

    I just like your false confidence in the 'industry' you used to be connected in some way. Ofcom doesn't inspire any confidence to me. Neither do some networks, Vodafone an EE in particular.
