ISP Contract Renewal Over the Pnone

Hello all
Yesterday I phoned EE/Orange and managed to speak to someone about my contract as I wanted to know my exact renewal date.
Twelve months ago, I renewed for what I believed was a twelve months contract over the phone with Orange CS. It appears that I have been put on an 18 month contract. I didn’t receive any paperwork confirming this and I certainly never signed anything. Does anybody know whether I am obliged to honour the 18 months (due to end this August) and if yes, where can I officially dispute?
I have just written a letter to EE basically outlining the above...Is there anything else I can do and what is their likely response?
Many thanks
B

No signature is required to create or extend a contract with a new minimum term. A verbal contract has exactly the same validity-it's just harder to dispute the precise terms. No free lunch, and no free laptop0

Thanks Macman
Then presumably, if EE/Orange have 12 month contracts then they cannot hold me to 18 month without signed paperwork?
Thanks

I don't think that's what's been implied, if you dispute the term of the contract they should be able to review the recording of the conversation you had with them and see if they mentioned the 18 month term or not, and if you agreed to it, or not, but just because they have 12 and 18 month minimum term contracts and they never sent you a document doesn't automatically mean you are on the 12 month term0 -
....Thanks iniltous..Even better and an easy resolution 99% certain that 18 months wasn't agreed..Just rewind and press play..! (Bet it's not that easy though):rotfl:0

Well, if they only have 12m minimum terms, why are they insisting that you are in an 18m minimum term?
As I said, signing or not is simply not relevant, as you have clearly accepted the T&C's by using the service for 12 months.. The dispute here is over what the T&C's are.No free lunch, and no free laptop0 -
I imagine that they have 12, 18 and 24 month contracts...but 12 is the minimum...Maybe it's something as simple as them ticking the 18m box instead of the 12m box by mistake...Understand the irrelevance of the signature because of my take up of the service though I've noted that without initiation from either party you cannot automatically be enrolled onto a new contract when your old one ends - it becomes 'pay as you go'...The dispute is most certainly contract length.
If the recording does exist as suggested then resolution should be straightforward.0 -
Orange do have 18 month contracts. They are usually tied to some special offer. If you are sure you only had a 12 month contract then raise a dispute. It will be looked at by management.
I have raised a dispute with Orange, and won; and a friend of mine raised a dispute with EE/Orange a couple of months ago (and won).
I get the impression that they have to have proof that you entered into an 18 month contract (or whatever). If the contract was made verbally over the phone then they have to look at the transcript of the phone call. If this was not the case then they could just make any claim they like.0
