wrong permit? PPC NTK - Advice please!

Apologies for starting a new thread, but I couldn't find another case/thread that seemed to fit my same situation.


I work in a hospital in England, and pay monthly (approx. £15 per month) for a standard staff permit to CP Plus direct from salary. As a doctor I work busy unpredictable hours and need to have urgent access to the hospital. The closest standard staff car park to my department is in the process of resurfacing/being dug up for some reason, not sure if this being done by CP Plus directly, meaning there are very limited spaces here at any time of day, and other standard staff car parks are usually equally full, not to mention a significant distance from my department.
I have therefore occasionally been using a closer staff car park, marked as priority, which always has plenty of spaces, when there are no spaces in the standard car park (several other colleagues with the same permit as me do the same, although that is probably not relevant to an appeal. many of them have received notice to driver or NTK letters, but everyone I know of so far has ignored both). I have received a couple of windscreen sticker notice to driver PCNs, and so far ignored them. All £60 fines, down to £30 if paid within 14 days. However I have since received a Notice to Keeper, within 56 days of the Notice to driver ticker, through the post after CP Plus got my details as registered keeper from the DVLA, saying that I now owe them £100.


Can I still make a valid appeal to the PPC on the grounds that:


1 - they did not provide adequate nearby standard permit staff parking facilities whilst performing resurfacing work


2 - that I pay a significant monthly/annual fee to them for a permit, and that their claim for £100 is excessive


or any other grounds that I've missed out on? or does the fact that I did not have a valid priority parking permit for that particular car park mean that I don't have a leg to stand on and should just cough up an await the arrival of more NTKs?!?


sorry if this is a repeat post from anywhere else, I couldn't find any advice on the newbie thread about what to do if you have a permit, just the wrong one!! advice gratefully received!

    Also have a read of the 'NEWBIES - READ THIS FIRST' sticky thread at the top of the forum. Learn how to write a first appeal asap to CP Plus as registered keeper which talks about the permit and the driver in the third person (NOT implying who was driving even though you may think it is obvious). By the way, you will not actually win the appeal and you do not write the same version for round two (POPLA) because an appeal about permits won't win.

    So, when if they reject your appeal, use the POPLA code with more help from that sticky thread for NEWBIES which has a post #3 about 'How to win at POPLA'. And we win every case and it's not about permits which is why the NEWBIES thread doesn't dwell on them!

  • 1) Not a valid point - for CPPlus appeal - they would not be responsible for resurfacing the roads etc. But you could complain to the HR department at hospital.

    2) - Part of the appeal : here is a suitable template first appeal but

    Have you not read the Newbie Sticky thread yet: - you need to also check if the Ntk is compliant as this can be added to the following:


    Dear CPPlus

    As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to your company is denied on the following:

    1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner as a fully paid permit has been purchased.
    2) Your signage does not comply with the BPA Code of Practice
    3) You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass

    These points and others will be raised with POPLA should you not accept this appeal, and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner.

    If you do reject the challenge and insist on taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

    Any communication that does not either confirm cancellation or include a POPLA verification code shall be reported to the BPA as a breach of their Code of Practice - the BPA recently issued guidance to all members to remind them of this fact. Such communication may also be deemed harassment and pursued accordingly.

    thanks both, that's really useful,, will try that in the first instance and see where we end up!
    i've looked through the newbie thread list info, and it looks like the NTK is valid, so will just have to see if i get a popla and take it from there!

    If you can get a picture of the CP Plus signage wording, and link it here in a broken link (no http:// and a gap in the URL to break it, as you are a newbie to MSE) then that would help us to be able to tell you whether you are likely to win on the usual magic words at POPLA 'no GPEOL'.
