PPI - Yorkshire Bank

Hi. I need some help! My husband had PPI on 2 loans in about 2000-2002 with Yorkshire Bank. He moved banks in 2004 and over the years has got rid of his paperwork. I've written to Yorkshire Bank several times but there reply says theydo not keep paperwork that long but if we send £10 they will do a Date Subject Access Request.
Why can they not give him details of his account and loans but can find them for £10?
We also don't want to pay and get the same response as the bank account and loan was about 10 years ago. He did a Experian credit check but that only shows last 6 years. Any info will be greatly received!!! :-)

Did he pay by direct debit, assuming he did from which account?

I found my a/c number was the ref used on my Direct Debit. (my loan was HFX) so it might be the same.

If not I've heard of people been able to just supply name, address and DOB and as much info as possible and been able to complain.

  • Thank you - yes he would have paid by direct debit. It was before the days of internet banking. He had a current account with Yorkshire Bank and a loan with them as well.
  • Does a SAR mean you will get information beyond 6 years ago?
  • Sorry me again, we've also written to them several times but everytime its the same reply. No information but you can pay £10 for a SAR?

A DSAR will require someone to check all relevant files (that's what you pay for), but it doesn't guarantee you will receive anything older than six years.
It's your choice, therefore, whether to proceed.

You'll only receive the records that exist. Some banks are more fastidious than others in applying the six year rule to their records.
So it's a bit of a lottery what you might receive.

Maybe you could just send them something like this?

Although even if you did get a refund offer, you would not know if it was correct as you don't have statements to check how much you paid.

    Dear sir/Madam,

Ref: [Your PPI policy number, or a/c number]

I took out a credit card from XX bank. At the same time, I was sold a payment protection policy.

I believe I was mis-sold the PPI policy because -

(Insert your reason(s) here) for example :
    • I was self-employed at the time. Therefore, under the terms of the policy, I would not have been covered if I'd found myself unable to meet the credit card repayments.
    • Your advisor was very keen to promote PPI as a useful product for me to have. The advisor was pushy about me taking PPI and I felt I was given "the hard sell". In the end, I agreed to PPI when the advisor said I was far more likely to get the credit card if I accepted PPI.
    • I was also not advised that I could have purchased PPI from another independent company other than yourselves. Therefore I was not given the right to make an informed choice either as to what policy, if any, would have been more appropriate to my needs, or as to the cost thereof.

Companies selling insurance policies must make sure that the policy they are selling is suitable for the customer's needs. The policy I was sold was quite clearly unsuitable for me because of the above reasons.

Because I was mis-sold this policy, I wish to request a full refund of all the premiums that I've paid, plus interest.

Please investigate my complaint within the eight weeks allowed to you before the matter can be referred to the Financial Ombudsman.

    Yours Faithfully

It's very hard to make a robust complaint if you don't know for sure there was any PPI. Suggesting that the OP send a speculative "complaint" is unfair to the thousands of people waiting for the outcome of genuine complaints.

The OP should spend the £10 on a SAR and see what comes back.

Ok, but I've read a few threads about people doing this and getting something back.

Doesn't this belong in the PPI section anyway?

    Certainly does...
  • Can anyone confirm whether Critical Illness Insurance is a form of PPI?

    Thank you
