The fixed penalty will be ultimately far easier then risking a court appearance.
If the 3 points causes you a problem (e.g. employment-wise) then you shouldn't have done it in the first place.0 -
Its 3 points no matter what you do, pay the COFP it will be £100 go to court could be up to £1000 or £2500 if you were driving a LGV.
There are defences but unless your mega rich you can forget them!0 -
I got an other problem. I realized from the forum, the best thing is to take the 3 points and pay £100. This is something I'm going to do.
I have the card version of the driving liense but I couldn't find paper side of the driving license. I told the poilce officer I want to pay the fine and get the point. She said we will have to take you to court now. I said can I not just apply for the other half of my driving license and wait for the DVLA to send it. She said it will take 2 weeks but you are required 7 days to show prove off the paper and card version of the driving license. If you don't have it, you will be taken to court.
I'm not sure what to do at the moment?0 -
Even using a hands-free kit can get you a fine/points.
In Essex the Police regularly run 'Surround the Town' operations & they will often do drivers for using hands-free if they believe they are not concentrating on the road.Never Knowingly Understood.

sorry to say there is no excuse and I have had near misses with distracted drivers on the phone too
leave it in your pocket or bag or glovebox, they arent that important when you are driving, there is nothing so urgent that requires them to be used whilst driving
so on this one you do not have my sympathy either and I would prefer they increased the penalty points and fines because I know somebody that got hurt in an accident with someone else using one whilst driving, so through no fault of their own !

You can sometimes get a replacement licence online if your details have not changed and they can verify you, a lot quicker. You have 28 days to pay the FPN.
