by positioning themselves just before the 40 sign, it is clearly an act of trickery as opposed to genuinely trying to prevent accidents.
I fail to see how it is trickery, the 40 limit does not start until the sign, its not a case of you having to be doing 40 by the time you reach the sign.
If the speed gun was facing the other way, it would be catching motorists that had not slowed down it in time and were going over 30 just after the sign.

Its all a learning curve and if you don't learn to obey the speed limits then you will get caught every time.

    Hi all,
So today I got 2 identical letters in the post, 2 speeding fines from the 17th Jan, one at 14.18 another at 15.03 :/ same road, same camera (mobile unit) doing 36 and 39 respectively in a 30 limit. I will say that the road changes to a 40 just yards after I was caught speeding, which is why I was speeding, because I was simply accelrating up to speed! But I know thats no defence from a legal perspective.
However, is the fact that these offences were both committed less than an hour apart a reasonable defense in favour of one being discarded? Im 21, have held my licence for nearly 3 years and its a clean licence until now. Also, what are the prospects of me being offered a speed awareness course for one of them?
    Many Thanks!:)

I wouldn't be drawing attention to the fact the two incidents were so close together - it makes you seem like a regular whizz kid. More to the point, and it might not seem like it but I'm trying to be helpful for the future, your response (in bold) is a bit concerning as it suggests you think you ought to speed up so you're at maximum before reaching the sign. You're not, and nor are you supposed to slow down only when you reach it. Also, the speed limit is the maximum you're allowed to go - you don't have to drive at maximum. If you've held your licence for three years, maybe you've forgotten some of the basics.

The unfortunate thing is the effect it's going to have on your insurance. Points drop off your licence after four years, but insurance companies put your premiums up for five.
    . . .I did not speak out

    Then they came for me
And there was no one left
    To speak out for me..

Three? I thought it was 6?

edit: Quick google, It's 4 or 11 depending on the offence.
For the first 3 years they remain 'active' and count towards the totting up procedure (12 and disqualified)

Yes it would, but generally people dont do that, when you see a 40 sign a few yards ahead on the left you start accelerating....clearly this is about trickery more than actually preventing accidents. And the van was completely hidden, I did see it on the way back the 2nd time and braked but it must have just caught me :/

"everyone else does it" is also not a viable defense. Might be because I know the police are notorious around these parts for catching motorists out, but always go by the speed for the stretch of road your front tyres are on. That means you don't accelerate prior to going into the higher speed zone & you slow down prior to hitting the lower one - cops can't hit you for speeding that way.

Thanks, you're right. I was double checking as you posted. I've corrected my post. It's three years for totting up, four years on your licence and five years for insurance.

And eleven years for some offences!

Yeah i hope i get offered a speed awareness course and as for the remaining 3 points, i checked with a sample insurance quote and it only puts it up by something like £4 a month, phew! I'm starting to feel ok about all this now haha thanks everyone for the responses,

I can't speak for people in general but I start accelerating after the 40 sign and not when I first see it. Which might explain why I've had a licence for almost 30 years without (as of yet) getting a single point on it and you've had one for three years and you're looking at six points ;).

I have some potentially pretty bad news for you. Unless one of the tickets attracts a speed awareness course (you can only have 1 in 3 years) you are looking at reverting back to being a provisional licence holder as you have held your licence for less than 3 years. Get over to pepipoo and see if anyone can offer you any advice. The guidelines are hard and fast if convicted.

Its a bit like the "Pirates code", not so much a rule but a guide.
