CCJ Help?

I have a CCJ registered as Active on my credit File for £94,000. I can only assume this was for my house repossession however this has left me confused because the bank will have had enough equity to cover the loan. So why have I got a CCJ registered as unsatisfied 18 months later still?

  • You need to ask your mortgage lender what the house was sold for and when. Until the house was sold, your mortgage arrears would have been accumulating and they are also entitled to charge the costs of the sale to your account. However 94k sounds rather a lot if you didn't expect a shortfall all !

    The 94k is the amount that was owed on Mortgage. So they have claimed for whole mortgage. Even though they took possesion of the house which would have covered all this plus sales costs.

    Now that is a whole new issue - we need far more info on it.
    Are you saying they took possession, got enough to pay the amount owing on the mortgage - and then obtained a CCJ for the mortgage amount? - 2 bites at the cherry?

    There was a second interest that stayed in the property so they might have took the Charging order out then until she was out which was June 2012. However the property should since have been to auction and the balance cleared so why is a judgement still against my name for £94k as unsatisfied?

    What is that supposed to mean?? Your choices are fairly straightforward, you can speak with them and find out what the actual situation is or you can ask a bunch of individuals on a forum to speculate.


    Many of the guys and girls that contribute here are both helpful and knowledgeable but your question cannot be answered on the basis of the very limited information you have provided.


    Speaking to the bank was very sound advice. Why do you feel that you cannot do so?

    Do you have to need a reason why? It doesn't matter what the reason is, the outcome is still the same as in I cannot discuss my accounts with the bank at the moment.
