Can I return something to re-buy it at the sale price?

Why not just buy the sale item, then return the full-price item for a refund?
Or just ask at the Customer Service desk if they'd mind giving you a partial refund? (If it's M&S or Next or the like, they probably will. They'd refund the item in full then sell you back the same item at the sale price).
And to clarify the "is it legal" question ... the 28 day returns policy forms part of the contract. Therefore you can legally return the item for a full refund. They are not then legally bound to sell you the item back at the sale price, but most reasonable retailers would do so.0 -
Or depending on the stores policy they might only be prepared to refund the sale price.
A 28 day policy is on their terms and if they want they can impose this and some do.0
