Holiday Entitlements

Hi,

I have recently started a new job and the full time holiday allowance is only 20 days per year, this seems a little low to me is this the minimum statutory that is allowed?

It is a role in a retail environment and I am usually on rota to work a monday so not sure if I will be asked to work bank holidays too.

Any advice is much appreciated

    Minimum holidays is 5.6 x number of days you work per week (28 days for 5 days per week). They can include public holidays in this and other days i.e. if they're closed on xmas/ny etc...

    and 28 days minus 8 bank holidays is ...... 20. so yep they are a great employee, and abide by the letter of the law.

    If you work 6 days you don't get any more holiday.

    Check this out, as most retail is open most days you need to find out how they deal with the other holidays required to give you your statutory minimum.

    if not "full time" also check how the pro rata holiday allowance is calculated.

    I would say the norm is 20 days plus 8 bank holidays.

    The "norm" for retail (shop floor rather than head office accounts) is not anything "plus 8 bank holidays". Have you not noticed that most retail establishments are open on a bank holiday?

    The OP says s/he is working in a retail environment.

    If full-time staff (ie in this case working 5 or more days a week) get 20 plus an allowance of 8 as the equivalent of bank holidays, then the employer is meeting the statutory minimum. Until we know whether 20 is actually the full entitlement we don't know whether they are acting lawfully.

    If you work 6 days you don't get any more holiday.

    Sorry what is this nonsense? You are entitled to 5.6 working weeks of paid holiday. If you work 6 days a week you clearly get to take your whole 6 working days off as part of your week's holiday... In terms of your pay, if you start thinking about it in days rather than weeks then you start messing around with horrible fractions rather than 0.2 of a week per day, but it essentially makes no difference. Yes you receive more "days" but each day is paid at 1/6 of a week rather than at 1/5 so you don't get anymore money overall.

    There is a limit of 28 days set out in the amendments to the WTD that increased the limit to 5.6 weeks,

    This 'nonsense' is the law. It is 5.6 weeks of a maximum 5 day week or 28 days, your employer can offer more if they want to.

    The law does not reference directly 5 day week just the cap of 28 days(which is the same).

    AIUI(unless I have missed something having not read the full trail recently) this makes it a little more complicated because the legislation still refers back to the employment act and its definition of a weeks wage.

    There have been references on here to employers that cap at 28 days and make 6 day workers take 6 days for a week off.
