UKCPS letter before court proceedings

Hi all,
I read on some of the posts that just like them i was made to believe to ignore any parking ticket issued by private companies. I was given a parking ticket in one of the local car parks but there were no proper signages in the area. We took some photos just in case. Anyway, on monday i got the 3rd letter which i think was hand delivered. It says they are offering me that i pay £125 within 7 days and failure to comply will result in court action and i could pay a minimum of £325.The thing is the letter seems to be vague - there is no proper contact person in the letter. I read that i can challenge this letter, but where do i actually start?. And how can i be brought to court?
Thanks for your advice..

The advice regarding ignoring private parking charges changed over a year ago now.
Who is the letter actually from?
A solicitors or debt collector?i pay £125 within 7 days and failure to comply will result in court action and i could pay a minimum of £325
Should it go to court and SHOULD you lose the most it would be would be the parking charge, court fee and limited legal fees - most no more than £200 max in small claims.0 -
The letter is from ukcps..and it's from collections department
It says typical breakdown of costs following court action :
Orig. Amt. £100
Preparation of court papers. £50
Court and hearing costs. £50
Expenses. £125
It is for parking without a valid permit or authority. And it was issued at 8 pm. Obviously, since it was local to me i wouldn't have parked if i was aware that it was a no parking area. But there were no proper signs and the shops have been closed for a long time. And it was right behind he restaurant where we went.i got the photos to prove this0 -

Yes, if this is a '10 Day Notice of Court action' then that is UKCPS' version of a LBCCC so needs a robust response.
The best scenario would be if this was a postal PCN (no windscreen PCN alleged to have ever been issued) and if the registered keeper can write giving the name and address of a different person who was, of course, the driver on the day...
Then UKCPS can only send a new Notice to that person and leave the keeper alone (BUT ONLY IF THE DRIVER NEVER HAD A WINDSCREEN PCN!!). The second person (the driver) can then appeal and win at POPLA like the keeper should have done all along. You read very old advice if you thought you should ignore a fake PCN in 2013.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hello,
Do I send them an acknowledgement or a challenge ?
I am thinking of doing just one reply to put in the points that (e.g. no signage, no legal capacity to offer contracts, does not represent pre-estimate of loss) and also adding the non-compliance to practice direction.
would this be ok ?
one point too, because i got the letter on monday, 27th (but it was dated 24th). It says i only have 7 days to accept their offer for me to pay £125. I thought it is suppose to be 14 days.
thanks for your help in advance0 -
The chance of an appeal has gone and what you have is UKCPS's version of a letter before action. Take a look at the following thread and once you understand it draft up a letter using the template suggested and we'll let you know how it looks. Their 10-day letter does not conform with the requirements of the practice directions so your response needs to be robust.
https://forums.moneysavingexpert.com/discussion/4754020My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com0 -
Thanks for your reply, HO87. I've sent you and coupon mad a copy of the letter on pm. I think it's too long to post in here and ukcps might see it , anyway.0
