  • Maybe the job has been pulled and their now trying to find an escape?
it sounds strange if there hadn't even been the DBS check start undertaken, sorry to say but nothing would surprise me anymore.

Did you ask them about the possibility that an error was made, hence needed to be certain about the information they had. For exemple, a reference that went to previous HR department to fill in rather than previous boss and that was given to a young trainee who looked at the wrong file, hence stating that you have been disciplined for drink driving whilst on the job, or something of that sort....

Saying that, their attitude to it all would send alarm bells as to whether it is the type of company you would want to work for.

I've written a letter to them on advice from ICO as they have to be able to send me any records they've obtained about me. They were so cold with me, no sympathy, almost like I'd hidden something major from them and they were angry with me. I'd understand that if I actually knew what I'd done!

This may not give you all the information you need, references are exempt from disclosure.
  • It certainly has made me question the ethics of the company to not give me a chance to explain myself or clarify anything. Yeah I did think that perhaps it was a get out for them, but frustrating none the less.

I was under the impression that you are allowed to see references that were given for you?

I was wrong references given are exempt, not those received by a third party. However they can decide to only disclose partial information to avoid identification of the person giving them.

Section 7 of the guidance covers it:
