    Any thoughts on the below draft letter to POPLA would be appreciated! :)


    Dear Sir/Madam,

    I have received a ‘Notice to Keeper’ from UKPC regarding the above parking charge and inviting me as the registered keeper to pay their unbelievably high charge of £100.00!
    As the registered keeper of vehicle, I contend that I am not liable for the parking charge and was not the driver of the vehicle at the time.
    I have entered into UKPC’s appeals process, however, despite pointing out my grounds and requesting information they have failed to supply, they still maintain that they are entitled to make a demand for the payment.

    I wish to appeal against the PCN notice on the following grounds;


    • The charge is a penalty and not a genuine pre-estimate of loss.The charge of £100, by far exceeds the cost to the landowner. In my appeal with them, UKPC did not address this issue, and are not prepared to evidence the justification of a £100.00 charge to me, as an appropriate pre-estimate of loss.
      For this charge to be justified, a full break down
      of the costs suffered by UKPC must be justified. Normal expenditure the company incurs in order to carry on their business (e.g. provision of parking, parking enforcement or signage erection) should not be included in the breakdown, as these operational costs would be suffered irrespective of the car being parked at that car park.
    • UKPC are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass. Furthermore, they do not have the authority to issue charges.
    • A POPLA reference number or form was not supplied by UKPC despite me making two requests for one and this despite the fact that DVLA has instructed the BPA that their members must comply with this requirement! They only supplied the information in their latest correspondence when they informed me of my failed appeal. They are clearly in breach of the instruction and are not entitled to obfuscate, by pretending they can 'put the case on hold' rather than supply a POPLA code and rejection letter or cancellation.

      On the basis of the points I have raised, this charge fails to meet the standards set out in paragraph 19 of the BPA Code of Practice and also fails to comply with contract law.

      I respectfully request that my appeal be considered in light of the above and hope for a fair decision.

    doesnt seem much there compared to a standard letter or the guys-dad template letter

    have you actually compared it against the examples linked by coupon-mad in the NEWBIES sticky thread ?

    all explained clearly on page one of this thread (site navigation) by myself , coupon-mad etc

    as for the fact you werent the driver, if they satisfied POFA 2012 then they can pursue the RK , ie:- YOU

    if they didnt follow POFA 2012 , only then can they pursue the driver only (and not you)

    so the fact that you were not driving could well be totally irrelevant , you have had enough time to study the forum and work these kinks out for yourself , between the start of this thread and today

    I've paid my £16 to an appeals service save me time faffing around to ensure that I can formulate a good appeal.
    The appeal was worded much the same as the one I posted above, which I was told didn't have much there!


    I'm sure that this forum has helped several people fight the unfair demands made by parking companies, but if I were asked to help someone to fight an unfair demand, I would tell them exactly what they needed to do if they were clearly experiencing difficulties in navigating and finding the information they needed. £16 is a no brainer compared to a handful of hours searching for the info and formulating an appeal.
    Job done.

    you were given every possible type of help to navigate these forums and find it all out, but unless you pay (which you have done now) - nobody is going to do all the work for you as every popla appeal is different and tailored according to the PPC and parking charge and the land it was parked on etc

    The problem is searching through the messy website to get the information. I appreciate that there are different circumstances prevalent, but mine was pretty basic and those in the know could have quite easily said something like, 'In your circumstances ensure that you cover the following points...' I certainly would, but then everyone has their varying thoughts on their extent of offering help.
    A demeaning response was not helpful, especially when the appeal lodged was pretty much the same as I had posted, so although I could have added belt and braces stuff, I wasn't far out, but sent off looking again!
    Anyway, glad it's eventually been sorted!
