  • Hi. I am on dla low rate for care but doesn't open up anything else.though I am applying for a change in my condition which is affecting my mobility. I'm currently claiming housing/council tax benefit. If I don't try for these things I won't find out if I'm entitled to them despite using the different adviser sites. One said we could get wtc but I was told no when I filled in the paperwork. I might write to I.D.Smith just for the hell of it though!
  • Only by calling the DWP or possibly even trying a call with ATOS, can have the slight possibility of cancelling this medical in your particualr circumstnaces.

    Call the DWP using the number on the DWP letter you received about your change to Support Group.Possibly consider a call to ATOS as well. And ATOS on the number on the letter telling you about the medical date.

    When on the pphone, explain you've just won your appeal to be moved to Support Group , and mention the 18 month reassessment time recommendation. Stay calm and polite as possible, beacause you're asking a favour. Ask if it's really necessary for you to attend another asessment so soon. You might also mention some people have had their medicals cancelled in similar situations and you wonder if this is possible in your case. They may or may not agree to help. Might have to be passed up the chain..

    If they should agree it's too soon, ask for written confirmation the medical date is cancelled. .It's essential you get written confirmation before the date of the medical. Or you risk a failure to attend and your claim unless you attend on the day.

    Not sure where a doctors letter came into this, and can't see it helping in this case.

    If they can't or won't cancel it , you can call ATOS and ask to reschedule the appointment once which will put it off for a few weeks. Or ask ATOS for it to be recorded which might delay it for a bit longer.

    So the Dwp number is the one on the sheet that says jobcentreplus on the top left and reads the following?

    If I asked for a letter from my GP to support me then what address would i need to send the letter to and would I need to phone them up to tell them that I will not be turning up to the assessment and that I have sent a letter from GP explaining my reasons?

    If you don't turn up for the assessment, with our without a GP note, you run the risk of your claim being closed! Yes, it might be overturned on appeal, but there would be no payment meanwhile. Please think very carefully before you go down that path.
  • I've just looked at the tribunal decision (thought i'd lost It) and the original decision was made on 29/01/13 and It says :

    "The tribunal recommends that the DWP does not reassess the appellant within 18 months".

    So if it's 18 months from the original decision then that would be the end of july or early August.

    Not even 2 months after winning my tribunal and they want to see me again.

    It's the thought of having to through another reassessment where they fail me before I even enter the room. The woman i saw for my assessment told so many lies in her report that i thought i was reading things.


    The folowing article has a woman admiting that she was dishonest and purposley failed claimants. She also says that Atos were telling her she was being too nice and wanted her to fail more people.

    I can't help but think of the people who don't have friends/family for support and have to go through the extremely long and mentally draining appeals process.

    Absolutely digusting, there are people killing themselves over the corrupt decisions that Atos and these assessors are making. Really makes my blood boil!

    As HB has correctly said not turning up for the apointment ans sedning in a GP letter is likely to get your beenfit stopped.

    The Tribunal recommendation is simply a recommendation. It has no legal merit. The DWP can reassess claimants at any point they wish to do so.

    On the basis of some other people's experience , I'd suggested you could try to persuade the DWP or ATOS to cancel the need for a reassessment so soon after your Tribunal. On the slim chance they might agree to it, so it was worth trying a phone call . And if they did to ensure you get the cancellation in writing . Otherwise you need to attend the reassessment.

    I'm not sure why you keep asking about sending in a GP's letter, as it's never been suggested. Maybe the thread content being misdirected by another poster is causing confusion?
  • It really is not personal, no one sits there and thinks 'who can we wind up today'. As already said, the eighteen months runs from the original decision, so your next assessment will need to be completed by June. There are delays due to the ATOS reports being audited before being returned to the DWP, so the time frame is about right.

    Is your GP supportive, and do you have additional mental health support? If so, well phrased letters from them could mean you do not need a face to face assessment at all.

    I was suggested the above skintmacflint.

    What the tribunal say about not assessing you is just a recommendation. It can be done sooner if DWP wish.

    I phoned the benefit centre earlier and they said that I don't have to go the assessment and that I shouldn't have recieved the letter in the first place but due to an overload of appeals something messed up. According to the person I spoke to I will not get reassessed until 2015.

    I phoned the appointment number for my assessment who then put me through to another benefit centre. The final person that i spoke to said that I would got need to attend the assessment and will not get reassessed until April 2015. She said I will also get letter in the post confirming everything she had told me.

    So is that everything sorted?

    I really hope so!!
