Certainly before parking eye, the site was leased to the parking company so it became their land, hence any letters saying they have no right or letters to the retailers aren't especially relevant.

Again, should set a timer and had 45 minutes to buy a ticket if you realised you were running out of time. I suspect that OPs husband probably left the site completely and isn't being totally honest here.

Annie, with respects don't presume that the OP is lying or her husband! If you don't have anything constructive to add then don't bother at all. And in terms of a parking company leasing the land, I highly doubt it as the landowner is not likely to do that!

  • Annie is wrong, this used to be run by excel parking and they never leased it all, before that it wasnt a retail park

Stroma - if you genuinely believe PPCs don't lease rather than just manage then you are sadly mistaken.

I know this car park very, there's no real excuse for not paying. You have every opportunity. And was it not for people abusing the facility then there would be no need for aggressive car park management in the form of ANPR cameras.

Kirbyinfurnesslad - I'd have to check something first, but I believe that this has been leased previously to a car parking company. I could be wrong, I might be thinking of a different site locally. If so, I apologise for providing misinformation, but it will check as I say.

The majority of the ppc business model does not involve leasing, ncp and napier are two exceptions,

One of the planning conditions for this car park is to offer some free parking, then paid after 45 mins

You are completely wrong. If you read through the thread you will see what caused the delay. If you can't be bothered to offer constructive advice then please don't post at all.

99% of car parks are not leased to parking companies, and unless you have sight of the contract you won't know this. I have yet to see anything from Parking Eye to suggest that they have leased anything, and that is after many court cases and popla appeals!

As for abuse, I would contend that genuine users of a car park who is using the facilities cannot abuse car parks! Making a mistake, or requirements under a reasonable adjustment in the Equality Act is not abuse!

And how can they try to levy an unlawful penalty of upwards of £100 for something when the actual loss is less than a pound? They are supposed to be claiming for actual losses as defined in contract law, not to enrich themselves! Finally it's not even Parking Eye having a loss it's the landowners.

I received a letter from Parking Eye this morning saying "we can confirm that this charge has been cancelled and there is no outstanding payment due on this account".

They haven't given a reason for the cancellation so I don't know if it was due to the appeal I sent to PE or whether one of the retailers asked them to cancel it.

Thank you to everybody who has helped me on this forum. It is very much appreciated.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
