Parking Eye

I'm new to the forums but not to MSE. Today I too have received a court letter from Parking eye, my situation is:

I entered a retail site carpark last year, however sightly off this carpark is a place where you can take unwanted household items which are then sold cheaply (mainly to people on benefits etc), I had to wait for someone to help me unload the car then returning to the main car park eventually found a space and continued to shop, I left the carpark approx 20 minutes after the free 2hours parking.
I received the 2 letters from Parking Eye which I ignored then had to sign for a letter which at the time I think was the letter before court action, I ignored this one too.
It's been so long after the event that I can't recall the dates but i'm sure it's around 6 months ago I thought I'd gotten away with it.
Parking eye are now chasing £150.
Any help would be greatly appreciated.

    Well you'll have seen the sticky threads at the top - so make sure you read the 'Small claims' section in the 'NEWBIES read this first! FAQs' thread. It has lots of links including to the Parking Prankster's Guide on defending a PE claim. You are not in the Cambs/Essex/Suffolk/Norfolk area are you?

    No I am in Mid Wales the retail site is the Rheidol carpark in Aberystwyth, reading threads and bits from parking prankster I see that PE at the site have been under the watch of trading standards as it's in an awkward spot leading onto a roundabout then onto traffic lights, at busy times it's possible to queue for 1o minutes or more just trying to get onto and off the carpark.

    What date was the alleged parking event please? I think we have details of the contract at this site and other links that will help you.

    ParkingEye have had several POPLA and court cases about this site, but never come up with a contract yet.

    Make sure your defence mentions this.

    ParkingEye are currently losing court cases because their contracts were either not in place at the time of parking or the contracts do not allow them to take action in their own name. Only the landower can take action.

  • One thing that does puzzle me about all this is the fact that the Craft part of the carpark used to be 'completely free' ie not under any PE restrictions, since this incident there are now 3 bays marked out with yellow lines and a parking notice similar to the others on the site. I know this as I have taken more items there recently (am having a de-clutter). On the day in question I had taken household items to craft and parked outside their loading bay but had to go and find someone to help me unload the car and confirm they would take the items I had too. I must have been there around 10 minutes before I even got back into my car and then back to the main carpark, then had to find a space and park.
    Aberystwyth is a seaside town, as well as a university town, where the population more than doubles in the summer months with tourists, and students it takes ages to find a space and the same to get off this site.
    I think all in wasn't even parked for 2 hours but it's so frustrating when you're just clocked entering and leaving.
    I have thoroughly read all the links you've all provided so far and think I'm well armed now. Am I safe to post my draught defence here or is it best to pepipoo.
