Why are solicitors claiming 25% of my compo?

  • Well, that was unexpected. Not because you posted something like that; all things considered it's about as useful and constructive as most things you post. I just thought it would take much longer for you to abandon your usual nonsense and actually make things personal. Ironically though that post will have benefited the forums as a whole, as hopefully anyone who actually thought that you had a shred of credibility left will now realise that you lost that long ago.

I was proud of that post. It made me chuckle and now no one else will get the benefit of it.

So if the OP ever returns and still wants to avoid coughing up 25% of his compo I suggest he buys one of these then.

    http://www.amazon.co.uk/Guidelines-Assessment-General-Damages-Personal/dp/0199664757

Injuries lasting up to seven days are valued up to £500 and injuries lasting up to 28 days are valued up to £1,000.

Plus "where recovery takes place between a few months and a year warrants an award of between £1,550 and £3,200"

Starting to get an idea of what whiplash (neck and/or back) is worth?

Of course if the OP has a serious injury rather than a minor one he really does need expert help.

  • That was a long post. Let me know if you want me to clarify any of it.

No need for me thanks, that was perfect :T

    Actually he would want this one;

    http://www.amazon.co.uk/Guidelines-Assessment-General-Damages-Personal/dp/019968782X/ref=sr_1_1?s=books&ie=UTF8&qid=1391039874&sr=1-1&keywords=judicial+college+guidelines+12th+edition

The one you linked to is the old edition. The most recent is the 12th. But yes, it gives a decent ballpark figure for straightforward injuries.
No need for me thanks, that was perfect
Glad to be of assistance. I think that might be the first time ever that you've thanked one of my posts as well. I think that's some form of progress.

That was a great post, thanks very much. Funnily enough a taxi driver told me recently that whiplash was worth about 2 grand. It seems he wasn't far off.

Seeing as I don't have a copy of the guidelines, could I bother you to put a figure on the broken finger I mentioned above?

    thanks

The people who put a blanket figure on injuries (i.e. "x injury is worth y amount") are always wrong because it is always dependent on how severe the injury is.

An individual fractured finger is up to £3,500 depending on recovery time, so not as specific as neck injuries and therefore difficult to value accurately without the assistance of case law.

  • How do whiplash claimants manage to get a payout of over £1500 within weeks of the accident if the guidelines for that amount are for between a few months and a year?

In most minor cases the injury might last a few days, max couple of weeks and the insurer will leap in with a pre-medical offer over £1k

Cut the claims management companies out

I certainly didn't see a taxi driver as a source of legal advice, I just thought his anecdote stood up ok when tested against the figures you gave.

His story was something like -> hit from behind -> went to GP for painkillers -> put in a claim -> got £1k. His solicitor advised that if he had more evidence, such as going to the hospital immediately after the accident he could have got £1k more.

Hence his conclusion that whiplash 'ought' to be worth £2k!

hi all and thanks for reading this and sorry if it's in the wrong place.
Was knocked off my bike, taken to A&E, bloddied bruised but nothing broken.
Have contacted Accident Helpline Advice as recommended by Ezter Ranzen as 'no win no fee solicitors' but feel i am being railroaded by them. I have to pay £245 insurance up front which i will get back if they win and their fee will be about 25% and they dont chase claims less than £1500.
Q1/ is this industry standard operating procedure?
Q2/ are all the ambulance chasing NWNF solicitors a much of a muchness or can someone recommend a firm who have delivered a good service and paid out.
    in anticipation, many thanks.
