I would have thought with COPD and unfit to do current job at 64 I would go to my GP and speak to them and get myself signed off, the stress of all this alone must be making you feel ill and is likely to make your condition worse.
Then at least you can get ESA in the meantime. Even if they (ATOS) assess you as fit for work you will have contribution based ESA (presumably unless you are self employed?) if you appeal any ESA decision it will take at least probably 30 weeks to come to appeal and they have to pay you in the meantime, by which time you will be entitled to your state pension.
You need to see someone asap to get some benefits advice for you and your wife.
Wish you all the best and hope you can get your housing situation sorted out soon as well.Think of all the beauty still left around you and be happy - Anne Frank :A0 -

.
That's the best post that I have seen in a long while - somebody actually being totally honest!
You certainly won't get good advice on this forum - it's generally full of the 'benefit bashers' brigade.0 -

Have you spoken to your doctor lately Andy? Replying to your own posts on alter-ego accounts is definitely worthy of some psychiatry.
I've only just noticed this post, I don't know why you are dragging me into it again?! You are all better off following your own advice and IGNORE him completely. Because nearly every single thread or new poster is being suspected and that is feeding more. If you feel posters are the same person then follow the complaints procedure.
It is hardly my fault he said what he did to me.

One thing re your wife claiming pension credits for you and I'm not sure as I don't really know much about PC's I was just thinking about your own NI contributions as obviously having as many as you can for your own pension is desirable, which was why I said about ESA. Hope it all works out ok for you.Think of all the beauty still left around you and be happy - Anne Frank :A0 -

I agree with you entirely, you have taken the words right out of my mouth.

This year as I have COPD which makes me short of breath I could not complete the walking treadmill. Both Drs said it has no effect on my heart and sent results to DVLA thinking it would come back requesting a higher level of testing in a different way done at a different hospital or be passed as I do tankers which requires no loading/unloading etc just driving. They have taken over 6 mths but now have passed me for car but NOT for my HGV. My wife gets a state pension. We have no savings. I planned to retire November as I get my state pension. We have a mortgage that stops November 2014. The house is up for sale to repay the endowment mortgage. The letter says we can appeal. We cannot afford legal help though. How do we live next week- how do we pay bills , I have worked all my life..what do I do ?
I do hope by now you are getting some help from somewhere and things get better for you and your wife?
If you do have any more queries (don't be put off by this thread) as many people here have a wealth of understanding of the benefits system and offer a lot of very useful and practical advice.
