    To cut the confusion, it's probably best to regard roadworthiness and the MoT as separate issues. 1) We all have a legal duty to keep our vehicles roadworthy at all times, and 2) there is also a system (the MoT test) to ensure that all vehicles get regular checks. The test doesn't ensure roadworthiness (except for the instant the vehicle leaves the tester's premises), but it does mean that any problems should be picked up and rectified eventually.

    One thought: if you presented a vehicle for an early MoT and it failed, you would still have a current MoT for the purposes of the MoT regs. But if you were prosecuted for having an unroadworthy vehicle the prosecution could argue that not only was the vehicle unroadworthy, but that you were fully aware of it and chose to do nothing about it. That might make any penalty more severe.

    Surely, anything on a failure is indicating the car is unroadworthy else it wouldn't be a failure in the first place.

    OP asked if he would be ok to drive it till May if he MOT'd it early and it failed.

    If it failed on a chip in the windscreen, side light out, split cv/steering gator or other minor fail then he would be ok to drive it.....if it failed on something major then he wouldn't be ok.

    As you know, this question was to do with whether a fail now would mean the previous MOT's expiry date was affected, not could the car still be driven till May if it was unroadworthy, which you keep banging on about.

    You must of read the OP's mind as he has only posted:

    my cars MOT expires May. If I take it in now for one and it fails, can I still run it until May ?

    and

    last years advisory was 'sills'. The year before it was 'corroded brake pipe' (though not on last years (! same garage)

    Why did he ask about May if it was for any other reason? May is when his previous MOT is due to expire!

    Nothing to do with being a mind reader. The clues as to the reason for the question are all there.

    To encourage drivers to keep on top of vehicle maintenance, the Vehicle and Operator Services Agency (VOSA) allows you to arrange a new MOT test up to one month before your current certificate ends

    So Johnathan is NOT correct... I AM OK until May.

    The reason... I am thinking of selling the car (Discovery), if it fails on too much. I want plenty of time to find something else before.

    WOULD the (assuming a) 'fail' MOT now, show up on the system, if someone were to check ? I assume it would.

    Im not sure what you mean you can take your car in upto 1 month before its expirery date giving you 13 months MOT

    any longer than 1 month and you will only get the 12 months
