We both responded to this email yesterday, before looking on here :-(
"Please be advised that we acknowledge receipt of your email, and will be responding directly to you in due course. However, prior to doing so we require the following information in advance to enable us to process your APPEAL/CHALLENGE. If you have not already done so, please forward the following information as a matter of urgency, as we are unable to process your APPEAL/CHALLENGE without it:
1) The PARKING NOTICE SERIAL NUMBER This can be found in the top right hand corner of the Notice and will be prefixed, SERIAL No. CS/____________.
2) A FULL POSTAL ADDRESS that we can correspond with, as all decisions are conveyed in a letter to the motorist.
3) The FULL NAME of the motorist."
this morning I spoke to a group of landlords, including two of their sons that have been ticketed for non permit displaying, according to their forms. The van also turned up and their guy explained they have now become excel. This explains why they have become more active unlike the last 3 years.
Some of the landlords are planning to speaking to the land management company this week about the relationship with the parking company.0 -
the above contravenes the BPA CoP
see here http://parking-prankster.blogspot.co.uk/2014/01/british-parking-association-limited.htmlThe British Parking Association Limited have issued the following guidelines to all members.
“the following practices may be considered as Code breaches and must not be continued:
• Asking the motorist to enter into additional correspondence to obtain a POPLA code
• Failing to include a correct and/or valid POPLA Code within the Rejection correspondence
• Issuing a POPLA Code with a date identifier which is significantly different from the date of rejection
• Appearing to indicate that the issue of a POPLA Code is conditional on driver details being supplied “0 -
Not using a liveried vehicle is a breach of the BPA CoP as well. All worth reporting to the BPA but don't be fooled into thinking BPA CoP breaches win a POPLA appeal because in their own right, they do not.
However all will be well - let us know when you get the POPLA code and I can let you have the saved POPLA wording I have, suitable for a case where they are trying hard to make it look like a contractual fee for parking (but failed!). You will need to send POPLA your signage picture when you do appeal at that stage as it is key, just in case Conkai (who are owned by Excel I believe, have read this before) send a cropped/blurred pic without the black & white wording being readable.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

respond in writing if you can and obtain a certificate of postage.
State clearly that this is a served notice of appeal under POFA 2013 from the registered keeper of vehicle _)&)(&^(*^.
If they write back with the same bumf, you can then serve notice of discharge of POFA 2013 as they have failed to adhere to it in considering an appeal.Be happy...;)0 -
where is your contract as well.Be happy...;)0

This is probably a breach of the Landlord and Tenant Act, potentially a criminal offence, depending on what your AST or rental agreement says. You may be able to SUE your landlord for disturbing your quiet enjoyment of your property
However, it is better to join with him in fighting the Managing Agents/Head Leaseholder/Freeholder.
Get the invoice cancelled at POPLA but do not let that be the end of it. Put pressure on your landlord if you can, get other occupants involved, make life difficult for Excel, post notices, do a letter drop, put leaflets under windscreens. Read this and chuckle.
