Slipped disabled badge - help please

I parked in a disabled bay at local cinema and my badge had slid off the dashboard , therefore not clearly displayed UKPC proved this by means of a pic . I didn't receive the 1st reminder so missed the opportunity to pay £30. They now want £150 from me , even though I proved I had a disabled badge . Can they really enforce this? Any help would be appreciated - thanks in advance

blue badges are not really relevant as it was on private land, not the public roads

What happened when you complained to the Cinema Manager and/or Leisure Centre Management or site owner, where you were visiting? As you would, as per all the successes in the 'Successful Complaints about PPCs' sticky thread?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks for the replies . The cinema car park is free . The only place you can get a fine is in a disabled bay . Is it worth going to Popla as technically my badge wasn't displayed as it had slipped off the dash . Are they really likely to take me to court to enforce this or any chance they will let it drop ? I will try the cinema manager , but the car park is for other restaurant users to , so how could they sway the situation. ?0

#1 You didn't (and you can't) get a fine - it is a speculative invoice. Please remove the word "fine" from your vocabulary when talking about UKPC.
#2 There is probably a time limit on free parking, and also rules about parking within marked bays, so UKPC will quite happily invoice anyone they can try to scam. They won't just target disabled bays.
#3 UKPC don't do court (as yet). But you can easily get this killed via following the advice in the NEWBIES thread. (Appeal to UKPC, appeal rejected and get POPLA code, appeal to POPLA, win and laugh at UKPC for being morons).0 -
normally a landowner (shop/cinema) can have the charge cancelled by the PPC, especially when its pointed out the registered keeper has a BB and so is covered by the EQUALITY ACT 2010 , as they are joint liable (the landowner and the PPC)

generally they will push it, they rarely let it drop unless pushed , so best to push it and go to popla , but kick up a fuss with the landowner too, pushing the EQUALITY ACT 2010 card hard
as its a "free" car park no loss was incurred, so the landowner has not incurred a loss so no "damages" can flow from it , so you owe zero pounds

See what you think when you read all the successes in similar multi-store car parks, as linked in the 'Successful Complaints' thread. Loads of Store and Cinema managers cancel these every week, and if they can't then the overall leisure park managing agent can. Google the name of the place to find a contact phone number or landowner/agent's name. Harassing you about an aspect connected to your disability is illegal and they are liable for the actions of their agents = jointly liable for discrimination/harassment under the Equality Act 2010. You don't even need a Blue badge on private land as such, as the scheme is Council only. On private land it is different - disabled bays have to be available as a 'reasonable adjustment' for people who need them who meet the definition of disability under the Act (not BB only, despite the signs!). A slipped Blue badge does not take away the disability need and does not entitle them to harass you.
UKPC don't do court.
You can't go to POPLA unless UKPC give you a POPLA code or form with the code already at the bottom. Did they send you a POPLA code as an option on the rejection letter, or put a POPLA form on the back or attached? When is it dated? If you have a POPLA code we can show you how to win at POPLA which is a link in the NEWBIES FAQs thread at the top of the forum. DO NOT wrote about the Blue Badge in a POPLA appeal!PRIVATE 'PCN'? I am going to make a short video to show how easily and how quickly a badge left on a dash can be dislodged by a parking goon.
As these people that give out these tickets are all on a cut, the video will make interesting viewing .Be happy...;)0
