    That's true - but her intentions can also be evidenced by her actions.

    Gran had ten years to ask for the money to be paid back. As she didn't make any effort to get the money back, it would be hard to prove that it was a debt to the estate rather than a gift.

    This is depending on us having the whole story. If Gran has spent the last ten years complaining to relatives that the loan hasn't been paid back, her daughter may feel she has a case to pursue.

    OP, what does your mother/father (sibling of sister taking action)think about this?

    It seems strange to pursue a relatively small amount such as this through the courts, unless there is some bad family history.

    I agree, the fact that she didn't even want it back means it was a gift. And even if she had, in the absence of any contract, it is a gift.
