So you aren't too bothered about a refund at all then?

The guidance is on here, nowhere has anyone suggested you should ring them. If writing to them is simply too much trouble, just put it out of your mind and move on.

I have written to them. Knee jerk reaction was initially to call them.

I wrote and posted the letter the day it happened (Sunday).

    Hi,

Just been reading through, you're not still hoping to get a loan through these guys are you? It sounds like they are trying "mainstream" payday lenders which you can always approach directly yourself? If you have already tried and failed then I don't imagine that getting someone else to ask on your behalf will make any difference?

Looking at the t&c's on The1Loan's site re. fees:
We charge a fee up to £39.99 for providing the service of acting as a finance broker. By proceeding with your application you are agreeing to pay our processing fee. We specify the fee as part of our communications with You. If You do not enter into a loan offered by a lender or financier within the 3 months We act for You, We will refund your full administration fee minus £5 as stated in the Consumer Credit Act 1974. Refunds must be requested in writing at customerservices@the1loan.co.uk. to avoid repayments being sent to a wrong address. In the event that your card is declined, we will attempt take payment on that same card as many times as we desire for up to and including 60 days after you made your application. If you wish us to stop trying your card please inform us by post or email.

Apply for a refund, do it in writing.

Even if they find you a loan, don't accept it and apply for a refund! Just get your money back and chalk all this up to experience...

If you are really struggling, why? What with? You might not think it is any of our business but writing it down in black & white might make you reconsider...

Have you considered contacting a credit union? Or how about contacting Step Change and looking into something like a DMP if you're struggling with debt?

Finally - what kind of schiester company states "In the event that your card is declined, we will attempt take payment on that same card as many times as we desire for up to and including 60 days after you made your application"? this (apart from being extremely arrogantly worded) suggests that even if you don't have money and want to cancel your request before the money is there and available to take then they'll take it anyway and send you down the route of having to claim a refund...

    Great stuff, good luck.

It will work but takes a little time. Keep calm and understand the process up to the FOS.

Keep us informed along the way. I wish more people would actually write (as you could tell by my tone!!)

This didn't really happen though, did it?

The Police MIGHT suggest that you contact Action Fraud at best, at worst they would tell you that it is a civil matter.
I admit to missing a few out myself*, but OP didn't read ANY...just blindly ticked a box to say they had.

    That's irresponsible.

    * The difference is I wouldn't look to blame anyone else when things went wrong.

One poster called a liar and one irresponsible. MSE thinks there is a problem. Some "experts" on this board don't. Wasn't this a board where people get suggestions on how to deal with problems instead of insults?

The poster whose mum got a police crime reference number after simply walking in off the street with an accusation regarding a civil matter, ie a contract, was the same poster who says their mum is/was receiving 100 phone calls a day from loan providers.

    Takes some believing doesn't it? I mean, work it out...even if they're spread over 11 hours (9am to 8pm) that's 9 per hour...one every 6 minutes...every day?...for weeks?...I don't think so!

And as for my use of the word "irresponsible", what other word is appropriate for not reading information presented to you...but saying that you had?

Banging yor debit card details in to various web sites and not expecting to get charged is irresponsible.

Not reading basic financial T&Cs is pretty irresponsible too.

The crime reference number? I don't believe it. There may have been a conversation with a policeman. There may have been a reference number issued. I don't believe it's a crime reference number and I don't believe Mr Local Plod is investigating.
MSE thinks there is a problem. Some "experts" on this board don't.
For what it's worth, I think these companies are a scourge on society. But they appear to operate within the law. I agree, it's a problem. But it's a problem that easily avoided if you have an IQ somewhere in double figures.

Don't give out your card details. Read the basics of the contract. Write to get a refund if you didn't.

The way to deal with it is not to give your card details out in the first place.

If you've already made that mistake, the way to deal with it is to write for a refund.

Numerous posters have dished out these world changingly brilliant suggestions.

This board has done exactly what you think it should do.

Perhaps an exaggeration but that doesn't make it an out and out lie? My mum is terrified of debt, she lives her life convinced that she is in massive debt because she has to pay £42 onto her gas payment card in a couple of days and is convinced that if she is late then they will cut her off...

If she gets a call from nPower she panics and in her mind that one call might as well be a call 50 times a day, every day of the week!

Some people handle pressure differently, that's all...

The real point is that the person posting this thread came here asking for help but instead got called an idiot and effectively told that it is his own fault!

Ok, so he isn't without blame but he was suckered in! He wants help, so help him or don't bother posting as far as I'm concerned... If you went to CAB with a problem and they started out by slating you what would you think and feel?

Edit: On a more personal level, in my darker days as a gambler desperate to get money... There were times when I would give my mobile number out (ok, I admit I personally would never give my card number out without checking) and within minutes would easily get a dozen calls and maybe the same amount if not more texts within a couple of hours and they would continue for several days...

Without going back to see which post you refer to, I will assume it isn't suggested you did see them at all. The point is you ticked a box to say you had read them, but didn't.

You probably won't either, seriously, do not bother emailing or phoning.
You just need to keep a level head, you have requested your refund, next make a complaint, again by letter posted recorded delivery.

If they still don't respond, use the FOS, instructions here

None of the derogatory comments bother me. I will fuel certain people's efforts to make me look like some sort of fool for making a mistake by saying that I am in fact educated to Masters Degree level.

There you go. Academically in the top percentage of intellect in the country but made a mistake.

I have been trying to convey to one poster in particular that I do not recall seeing ANY terms and conditions - yet they continue to harp on about that and insist that I did...

And I agree with the poster - I posted messages on here hoping for words of encouragement, support etc. Some have simply pilloried me.

I will stay to see what get posts in response to this and I will let people know the outcome (for the benefit of those who have been supportive and shown compasssion only) and thereafter I will not be using these fora again.

Are we supposed to be impressed by this? You are educated to masters degree level? So what?

And you're in the "top percentage of intellect?" :undecided

Can you make more sense? People may be more likely to believe you have a 'masters' then. ;)
