Charterhouse Claims - Issues / Harrasment ??

I'm helping a friend who decided to go through CHC to reclaim his PPI in Aug 2012 for loans and credit cards he had.

The initial cold call got him signed up with the promise of monies to be reclaimed from PPI

For nearly a year he hadn't heard anything from these people but then in Oct 2013 he was told that he was due 5700 from a loan he had taken. Out of this they money they wanted £2078 for their 'fees'.

He had mentioned this to us and we are not happy with this huge charge as I don't believe these charges were clear from their call.

In October he received an invoice advising he needed to pay them £2078 for a suggested payment from Barclays.

This money has never arrived and we have told CHC this but they did not listen.

In Dec 2013 we received a 'notice of court proceedings' stating he owes £2255 and with added court fee and and legal fee they total this to be £2510.

We have emailed CHC back advising their terms state 'no win, no fee' and that 'invoices do not need to be paid until fees are received'.

They are constantly calling for this money at all hours. Would you call this harassment, fraud for them demanding monies against which he doesn't have and may not actually receive or going against there terms and conditions which would void our contract.

Any advice on this would be appreciated.

    do not email. Put it in writing. Keep a copy and use recorded post.

    Contact Barclays in writing and tell them that the claims company say the complaint was upheld and that £5700 was paid but you have not received it. If Barclays say that the complaint has not been upheld then you have written confirmation. If they say it has then they will know the money has not been received and can look into it.

    The court goes by evidence. So, this will get the evidence to support the defence if it goes that far. Indeed, a judge may well throw it out before it even gets to court if the initial evidence viewed prior to setting the court case shows that no payment has been made by Barclays.

    I suggest this is used in the first instance.

    I would address the complaint for the personal attention of Richard Metcalf, Thomas Frederick Morgan and and John Morgan, the Directors.

    I would list the experiences (with times and dates if possible) and tell them that you consider them to be harrassing you. Therefore if you receive any further demands for money from Charterhouse Claims Limited in respect of a non-existent complaint you will make a formal complaint to the Police under the Protection from Harassment Act 1997.

    I would not normally use recorded delivery. Proof of posting (free from the post office) will be sufficient - particularly if you also e-mail it with a cc to consumer@claimsregulation.gov.uk
  • Thank you both for your replies. We will get him to contact Barclays regarding the PPI claim from them.

    Having looked at the 'claims management regulations' which states the below

    "General Rule 2 – you must conduct yourself responsibly
    General Rules 3 and 4 – you must be directed by people with, and ensure your staff have, necessary competence
    General Rule 5 – you must observe all relevant laws and regulations. This includes The Supply of Goods and Services Act 1982 which requires you to provide the service with reasonable care and skill and within a reasonable time"

    I'm not believing these guys are dealing in a correct manor and now more like bully boy tactics.

    I'll get this letter off to them to address the issues also
