TESCO mobile cannot replace phone

I recently bought a black iphone 5 and it came through - worked perfectly it seemed, so bought an ipad to sync with it, cases to match and screen protecters.
Then realised volume up button didn't work.
So Tesco said someone would come to collect my phone and give me a new one.
they collected my phone but no new one.
waited a few days
called up to be told it was written i just didn't want it any more
so they said a new one would be sent
next day, they call to say iphone 5 in black is disscontinued and out of stock.
now i can either have a white one with £20 voucher, or cancel
but i had a black one that was under waranty, that is what i want.
i don't want the white one but want an iphone,
i said i would accept an iphone 5s in black but they said no.
can i make any sort of legal claim or have any power to request more than there offer?
i really feel mistreated.

They clearly can't supply what they don't have and Apple have stopped making the i5, so they won't be getting any more.
Take the free disconnection, get a new contact with an i5 somewhere else and move on.0 -

However, it's arguable that white isn't the same.
How recently have you bought it? Can it be replaced by Apply under their warranty?0 -

i bought it like 2 weeks ago now, apparently the white costs more than the black? which i guess could mean that the white i better and so they are doing all they need? but i don't want a white and as i say i have bought an ipad to sync with it?! i was just hoping they could do more. but as they have now taken my old phone they cannot get it fixed under warrenty apparently, but my argument is that is there fault not mine....0

not an ideal answer is not rude - it is just not ideal - i did press the tanks button to say thank you - but i was hoping for some leverage from hear to help me get what i want - as i feel that tesco are just doing what they want. i think if you are having a go at me for what i said then you are rude. saying the answer is not ideal is not me saying i know the ideal or that i am not prepared to listen - purely what is says on the tin - the response was not ideal0

if what you want doesn't exist, then there is nothing you can do to get it.
you could try looking elsewhere and seeing if someone else has the black one still available0 -
It was only my opinion, did seem a little rude to just say it wasn't what you wanted to hear and nothing else.
