I understand and I have not referred to anyone as the driver. I have sent the same email with a note at the beginning with the other PCN number.
To be honest even after sitting reading all the threads i could on this last night i think for anyone who has not done it before it can be pretty confusing to understand the jumble of information. Even if you have been a little condescending I am grateful for the help, I have drafter this email to S Clark is it okay?
Dear Mr Clarke,
I am writing with regards to the company Excel Parking, in the past 2 days as the registered keeper or the vehicle i have received 2 Parking Charge Notices for the same incident on the 05/01/2014.
PCN 1 : xxxxx dated 13/01/2014
PCN 2 : xxxxx dated 14/01/2014
In accordance with Protection of Freedoms Act 2012 issuing 2 separate parking charge notices for 1 incident is not allowed.
As I have informed Excel on the date in questions the driver did try to pay for parking but there were yellow covers over the machines where the driver was parking and there were no notices to advise drivers what to do instead.
I hope that you will rectify this matter promptly so as not to lead to it being taken further.

I am not trying to be condescending, its bluntness and exasperation due to what I see is wrong in this particular case , good medicine may taste unpleasant but its designed to get a worthwhile job done - not taste nice !
in the letters you sent to peel centre and toys r us you clearly implied you were the driver - no question about it , and peel centre communicate with excel , so by implication YOU HAVE named the driver - surely you can see that ? (this has happened before on here , people rushing and implicating themselves as a result)Hi
I am really unhappy with the agents, Excel Parking, as on 5th January 2014, I brought my son to Toys R us Stockport branch, so my son could spend his birthday money. When I attempted to pay the parking, as I always do, the pay stations were covered over with yellow covers...I was unable to pay and there were no signs on the machines to say what to do. I checked other cars and they all had no tickets.
On on the 15th January, I received a letter from Excel, with a Parking Charge Notice, for £60, stating that I had breached the car parking terms.
This is simply unacceptable, and pretty outrageous. I breached nothing, as the car park had no facilities to make payment during my time at the Peel Centre!
I have absolutely no intention of being held to ransom by a company for £60, when I had every intent of paying the charge on the day. If needs be, I will forward a cheque for 1 hours worth of parking charges for that day and nothing more.
I look forward to receiving confirmation that this email has been received and forwarded to the relevant department to ensure this matter is resolved quickly.

you also asked questions already covered in the newbies thread I asked you to read in post #2. its not our job to keep asking people to read it, yet many dont, or say they have and havent, or have skim read it, we may help other members but are unpaid volunteers , not highly paid solicitors
hopefully you are now more "in the ballpark" of this process and more understanding of it , you do not need to lose on a technicality, that is why excel will lose , on technicalities

I witnessed too on the 7th January that the pay and display machine was covered with no signs or facilities to pay for parking.
I was issued with a parking charge received today. I have followed this thread and emailed toys r is direct, the peel centre and Stockport council. I'm going to put it in writing to excel tomorrow as it's outrageous I'm so mad. Surely if more people contests it around the same dates they have to accept the grounds for appeal??0 -

Not unless you all complain to the BPA and DVLA as well (email addresses in the Newbies FAQs sticky thread near the top of the forum). This is NOTHING to do with the Council.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
