EXCEL Peel Centre Machines covered.

Hi, I have received a parking charge notice from Excel, on the date in question we parked outside toys r us the machines by toys r us were all covered up with big yellow covers and no signs to say anything. We presumed the machines were all out of order as no one else had tickets, so we just went into toys r us. Whats the best thing to do??

  • I have but I am still confused. Should I contact toys r us, peel centre or appeal it with excel do I state the machines were covered and that had they not been we would have paid?

    I am really unhappy with the agents, Excel Parking, as on 5th January 2014, I brought my son to Toys R us Stockport branch, so my son could spend his birthday money. When I attempted to pay the parking, as I always do, the pay stations were covered over with yellow covers...I was unable to pay and there were no signs on the machines to say what to do. I checked other cars and they all had no tickets.

    On on the 15th January, I received a letter from Excel, with a Parking Charge Notice, for £60, stating that I had breached the car parking terms.

    This is simply unacceptable, and pretty outrageous. I breached nothing, as the car park had no facilities to make payment during my time at the Peel Centre!

    I have absolutely no intention of being held to ransom by a company for £60, when I had every intent of paying the charge on the day. If needs be, I will forward a cheque for 1 hours worth of parking charges for that day and nothing more.

    I look forward to receiving confirmation that this email has been received and forwarded to the relevant department to ensure this matter is resolved quickly.

    ok, here is your excel soft appeal
    Dear Excel,

    As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to you company is denied on the following:

    1) this charge is not a genuine pre-estimate of loss
    2) your signage does not comply with the BPA Code of Practice
    3) you do not have the authority or permission to issue invoices at this location

    These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of of your alleged loss, and your full unredacted contract with the landowner.

    If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

    Please issue your cancellation within 35 days of this letter or supply a popla code to appeal to them.

    Faithfully

    your appeals should not have had the I DID THIS blah blah in them

    they should have said , "the driver did this" , "the driver parked up" , "the driver says the machines were covered up"

    dont know why people always have to admit things in such a throwaway manner ;)

    all you had to do was post a draft of your letter on here for checking and critique

    Sorry ;) its only in the email to the people who own the land not the email to Excel I shall do that one in a min following the advice you have given.

    I know but those letters would have been better if constructed using the third person (as registered keeper)

    dont give them any more evidence will you ? (peel centre could easily tell excel now)

    there was a case recently on here where the peel centre forwarded the complaint direct to excel
  • Oh no. Well hopefully not, i have already received an email from toys r us to say they have passed it on to customer service department for them to look into.
    Is that okay with what i have added in for no.4??
