default date last payment ???

Hi
just Wondering If some one let me know if correct or not


Does your default start from last payment as a company called c l finace that was on a payment plan with 6 other default accounts have changed default date to 2012 and down as settled but the other 5 defaults have original date 2008 default dates when plan started all was started on a dept management plan in 2008 give or take 3-5 months


all of them almost payed in next 3 months
cl finace payed up full now

    If you just stopped paying then the default date should be somewhere between 3 to 6 months after that.

    The default date should be the date in which the credit provider issued said default to you. This is not usually more than 6 months after you stopped paying them (but sometimes for different reasons can be)

    To clarify the default date has nothing to do with when you last made a payment but when the company decided you had broke the terms of your agreement and sent you notice of this by post.

    Best thing to do is write to the original creditor and as them for the default date.

    These will then be removed from your credit reports after 6 years from this date.

    The default date would usually be withing 6months of when you first fall behind with repayments/enter a reduced repayment plan.

    Debt collectors are not allowed to change the default date on your credit file when they buy the debt. If you write to complain to them that the date is incorrect and not the original default date and not in accordance with the ICO guidelines then they should correct it.

    now cli finace are saying they had a missed payment to them (the payment plan was payed on time for 6 years )and they have defaulted me for 65.00 in 2012 it was originally Santander default in 2008 its all settled now


    none of they others made new default date for missed or late payment seems strange

    They are not allowed to issue another default at a later date.

    e.g. see section 53

    This CL Finance. did they buy the debt from Santander and chase you for the debt? Or did you enter in to an agreement with CL Finance so they would pay your debt to santander and you paid CL Finance?

    If the latter you have probably entered in to a new credit agreement in which case they can issue another default. but at worst i would say this should show as a missed payment.

    From what i have just read about CL Finance then Santander probably would have sold the debt to them. In which case they cannot add a second default for the Debt. Call them and advise them that a default for the debt was issued in 2008 and as such another cannot be reissued. if they disagree escalate to a supervisor and complain.
