On 12 October 2013 at Virginia Quays, the appellant was issued with a parking charge notice for breaching the terms and conditions of the parking site. It is the operator’s case that the appellant’s vehicle was parked without displaying a valid permit despite signage at the site to indicate that this was necessary to do so. There is photographic evidence to support that the appellant’s vehicle was not displaying a valid permit. The appellant has made a number of submissions, however, I will only elaborate on the one submission that I am allowing this appeal on, namely that the parking charge amount is not a genuine pre-estimate of loss. The burden is on the operator to prove that the parking charge is a genuine pre-estimate of loss. The operator has not produced a breakdown of the costs incurred as a result of the alleged breach and has therefore failed to establish a genuine pre-estimate of loss. Therefore, in consideration of all the evidence before me, I am not satisfied that the operator has discharged the burden. Accordingly, this appeal must be allowed. Farah Ahmad Assessor

The letter if sent must be with you on day 14, which means it should be posted by day 12 to ensure that. I believe there is an extra day if the parking incident is on the weekend. You look at the date of the NtK and date on the envelope for postage.

In a civil court if you, as the recipient of a NtK, were to provide in a written statement or as part of a defence with a statement of truth attached to it, a clear account showing that it arrived with you on, say Day 15, then that is sufficient to rebut the presumption that it arrived 2 business days after it was posted if that would have put it within the 14 days permitted. The burden of proof is the balance of probabilities.########
