Letter after LBCCC - Parking Eye

After receiving a parking fine last October, I initially took the advice at the time to ignore all correspondence until I received a LBCCC. Checking the forum again , I noticed the advice had now changed and I drafter a response letter from one of the templates/ I now have received a further letter from claimant and don't know what to do. Can someone please help advise me?

the advice on here changed in easter 2013 so has not "just changed" as easter 2013 was about 9 or 10 months ago
the laws changed in oct 2012 so thats about 15 months or more since the actual changes for england and wales
so for england or wales, nobody last october would be saying ignore and I was starting to research all this last summer and it didnt say ignore back then either

Sounds like the same long letter of court case, the 'standard drivel' one covered in the LBCCC Fightback thread, the one I then wrote a response for a week or so ago and added it to the LBCCC sticky.
Brigil871, please re- read the 'LBCCC Fightback' thread near the top. I think you've missed the latest posts on it about the next letter & how you could respond and get it back to POPLA stage if you strike lucky. Don't write a weaker watered down version of my letter, but don't copy it exactly either as that's not the best plan (never use a template copied verbatim).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Basically I send back a modified letter saying their LBCCC letter was not fully compliant with PD and asked for them to send me a LBCCC which complies with the requirements of Annex A para 2 of the PD on pre-court action and then listed the information I required.SevenTowers wrote: »Can you scan and post the letters, removing any information that could possibly identify you?

We believe our LBCCC is fully compliant with PD on Pre Action Conduct. In the interest of resolving this matter without the need for PE to issue court proceedings, please furnish us with any evidence that you have to show that you didn't break the terms and conditions stipulated on the signage or make payment within the timeframe set out in our LBCCC.
The problem is I don't have any evidence, It is a pub car park and my son was just picking up a couple of his mates. He was parked up for 20 minutes, never left his car and didn't realise he should have purchased a ticket - seems a lot of money for an innocent mistake0 -
well, assuming this happened after oct 2012 it could have been resolved more easily at popla, for free
but thats all water under the bridge now and this PE business is what you have to face up to

that thread was lower down this page of threads so you should have read it and got the free download (its in 3 formats) , it also links to his book too (paid for)
he has also offered to try to help people going to court by posting on here and his blogs , so maybe you missed that too ? this could possibly be by getting you help from somebody in your area or from people on pepipoo (google his blogs, and google pepipoo too)
I suppose it all depends on how pro-active you are

So how is that any problem if you plan to reply with a version of the letter I posted the other week on the LBCCC Fightback thread? It's not anything to do with what the driver did wrong - it's all about what the PPC did wrong and dragging them to POPLA at the eleventh hour. Please, stop being blinded by 'what happened' and see this situation for what it is and use the tested letters (suitably amended) that we already post for newbies. Even if the PPC take you to small claims you'd be able to negotiate/defend, and there's no effect on credit rating - but for now be robust with each reply.
