Virgin Mobile Credit Report Lies

I am having major problems with Virgin Mobile.

I originally took out an 18 month contract in Oct 2011 at £17.99 per month. The phone broke after a month and I had to send it for repair. It came back OK but then we moved and I could no longer get a signal at home or at work. The phone then broke again and they told me to send it back again. As I needed a working phone and a signal I took out a contract with another supplier (no problems) and was going to try to cancel the Virgin one under the Supply of Goods and Services Act but decided just to ride it out and did not use the Virgin phone at all from Dec 2011.

In May 2013 I cancelled the contract online and by letter. Virgin contacted me to say there was an amount of £53.97 outstanding as it was a 24 month contract. I disputed this as it was an 18 month contract but they did not accept this at the time. At this time, however, they DID acknowledge my cancellation request. Throughout the contract it had NEVER been reported as paid to any of the Credit Agencies.

On checking my Credit File I noticed that they had suddenly reported this as a 'late payment' account to the tune of 4 months which has naturally affected my credit rating and has cost me in this respect as I have had to cancel a car purchase and pay extra to get a phone for my son.

I contacted Virgin Mobile who sent me round the houses for half an hour until I finally spoke to the rudest customer service operator in history who told me tough and that even though it WAS an 18 month contract they never received a cancellation request and so the amount was outstanding. This is a blatant lie as it is in contradiction to their previous assertions and they are refusing to correct the report to the agencies. I then asked to speak to somebody more senior and was put on hold for half an hour before giving up.

I am naturally furious over this as they have had a good deal of money from me without ever actually providing a service and have treated me appallingly. I would appreciate any advice as to what I can do next.

    Even thought they acknowledged the cancellation, you where still to pay the charges, if you did not pay them, then what they have reported on your file is correct.

    You say you moved, did you provide your forwarding address?

    Also, lenders are under no obligation to report payment history to CRA's, until or if the account falls into arrears or defaults.

    Did you sent the letter via recorded delivery?, do you have proof they accepted it in writing?
