Morrissons gripe!

I went into Morrisons this morning and saw KitKat chocolate on offer so I bought 5 packets, paid for it and left the store. Walking back to my car I spoke to my wife, told her about the offer. She asked me to go back and buy a few more to stock up. I went back in and bought 5 more. At the self checkout counter I was politely told that the store supervisor had seen me buy kitkat before and I will not be allowed to make any more purchases after this. I wasnt going to make any more purchases anyway but is there a policy as to how much chocolate I can buy at a time? Not that I was buying a trolley load of discounted chocolate.

    Did you ask to see the manager to clarify the policy?

    Was there a limit marked next to the kitkats?

    Seems a bit petty on their part.

    No I didnt see the store manager and there was a heap of Kitkat at the entrance with no limit mentioned. I only bought £10 worth of chocolate in all!

    Dont know about Morrisons - but the paragraph below is from Sainsburys website and I presume most supermarkets would operate a similar policy.

    3.1 To ensure availability of all our products, customers may be limited to a maximum number of items. Goods will not be supplied for the purposes of resale, and are only supplied for a customer’s own use as a consumer.We reserve the right to refuse orders that we consider are for commercial or non-domestic purposes or subject to onward delivery by a third party. Orders for more than 12 units of a single product line may be fulfilled subject to availability and at the discretion of the store. Quantities of goods supplied per order may be limited if the order limits availability for other customers or creates a potential health and safety issue for our drivers.
  • Morrison's do try and enforce such rules in my local store, usually when they suspect people are buying in bulk to put in there own shop - and this can usually be seen!


    They did when the chocolate tins were on offer last November, one guy was trying to get 20 and he was limited to 5!

    Its worth bearing in mind that any item on shelf in a supermarket is technically an "invitation to treat" which means you go to the checkout with it, and offer to buy it - in contract law they are entirely at liberty to refuse to sell it. Many people think that the item on the shelf constitutes an offer so accepting that offer and taking it to the till forms the contract but it doesn't. You don't have a right to buy if they don't want to sell it. So in instances like this its perfectly legal for them to choose to restrict the numbers sold to any one individual. Obviously written policies would clarify that but base contract law already allows the restriction.

    I was in ASDA yesterday and a checkout operator told me that the French and Belgians were over at Christmas buying up as many Celebrations as they could because they either flog them for 25 euros or sell them as bagged sweets at boot fairs.

    it's normal to have a limit of half a dozen or so.

    If you post a query or complaint on their Facebook page they get back to you quite quickly. I asked not long ago why the Carte Noir on offer was always out of stock (I felt they were holding back stock to sell the smaller ones) and within a couple of hours they were asking me which store it was. That evening I went shopping and the shelf was full again:p

    Really, I dont like them or quality street, cheap and nasty.

    What a shame 10 packs hardly seems excessive, especially on such a comparatively cheap item.
