Tmobile/EE problem need advice

This is a bit long and winded so bear with me


Have been with Tmobile for around 8 years as when my mum worked with them she managed to get me a friends and family contract making it pretty much a half price deal. Everytime I came to end the contract I would phone and they would offer and upgrade the usual still being half the regular price. Kept being told that because I was on the "old friends & family" deal I should never cancel this as they hve now changed the terms for new friends and family in that the person working there to get the friends and family would have to confirm they still worked there for every contract unlike the one I have which is a "lifetime contract".


In December I was due for another upgrade so phoned up and the 4th of December and was offered the s4 galaxy and was told the contract would be £23.99 a month but the first payment would be £39.99 and that it would be now called EE not Tmobile. So I agreed.
Got all the paperwork thru which stated the breakdown of payments would be £39.99 a month but no mention of any discount. I gave them a quick ring and they advised I would get a letter a week after my first payment was taken with the friends and family discount applied.
This letter never came so when I rang them up today when I got another text with regards to the next bill which is £45 (added £5 delivery charge for new phone) they told me I was no longer getting the discount as in late December they changed it so I wouldn't be entitled to friends and family and its too late to cancel my contract. So at the moment i'm stuck with a contract I feel I have been mis sold. I argued for a good 10 mins and when the guy checked with Tmobile whoever enabled the upgrade had mentioned the friends and family discount . I have to wait until and advisor at a service centre calls me back apparently to offer "some sort" of discount but as my tmobile account has been ended I'm no longer entitled to friends & family. I do understand with the change in company its easier to bump off these deals people had but do I have any rights with regards to being told it would be £23.99 and yet now they have decided no we are just gonna charge £39.99.


It really feels like Fraud but not sure if they can do this!! Just hoping someone can advice me if I have a leg to stand on.

  • If you were told the cost would be £23.99 a month then you were lied to although it is difficult to prove that even though a verbal contract is legally binding.
    Unfortunately it's all too common and these huge companies just keep doing it and usually people give in through frustration.
    You could try claiming against EE in the small claims court for misrepresentation or similar - EE won't want to fight that and if you get a summons sent to them that might tip things in your favour - I did that once with Dixon Stores Group and it certainly got their attention.
    You should find that an action in the small claims court is not too expensive and gives satisfaction when you win.
