    Dear Sir,

    Thank you for your email.

On this occasion we have reviewed the case further and have decided not to take further action, the Notice has therefore been cancelled.

The free ticket is only valid while you are in B&M Store or Dunelm. If you leave site it is no longer valid, the signs clearly state this.

Please in future ensure you park correctly. You are welcome to use the car park on a pay and display basis by paying the fee, you can then use whichever store you chose.

    Yours sincerely

I think they may have been following this thread and realised they might be in the mire.

    Whatever, great result Mark.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

exactly what I was thinking myself ;)

either way, good result or results

I still believe their "operative" failed to follow the legal argument supplied by the Judge in that Ibbotson case too

would have been good to get him into court to answer for his "Inactions"

Well Mark you know a bit about PPCs now and what to do - if you see any other tickets in that car park - a little message on their windscreen pointing them here could help!

Ouch! - I hope they don't pay and search the internet for help here or on Pepipoo then.

Of course Mark now you know the facts regarding this site - you could be a good smaritan and contact your local trading standards with the information you have;)

Without a doubt, I believe both cancellations are as a result of this thread because we know Napier read this forum and pepipoo. I have also never seen Napier let someone off so easily, twice, it made me laugh and spit my tea out!!

To prove our point I bet we suddenly notice in a couple of weeks' time that there's an amended t&c PDF about that car park ownership...the only shame about it is we were going to tear them a new one and now we can't.

There's always a next time, Napier.
