Have you got a POPLA code then? You are confusing me because you said you only just got the ticket! Beware of any pm about this matter, if it comes from a poster who is not a regular on this parking forum. Napier read threads & print stuff out sometimes.The company is Napier Parking
Hold your horses and search the forum for 'Napier' as a keyword as this lot are a little harder to beat...sometimes...
Please take a picture of the sign on site, and look at the webpage their ticket might mention. What wording does the sign and/or the webpage of car park t&cs say about 'breach' or 'failure to comply with terms' if at all?
I mention Napier (and a few other PPCs) specially in the Newbies thread as they are a slightly different beast with their signs - sometimes!

I am now confused myself, if he has a popla code, surely he has to use it within 28 days and not wait for the NTK ?
I dont even understand how this changed in such a short space of time from a pcn on site to a popla code being issued
makes no sense to me0 -
He should construct a GPEOL popla appeal and not include the mitigation, POPLA dont care if you had a ticket or not, they only allow points in which they are backed in to a tight legal corner and this is because they are afraid of getting reprimanded by the Local Government Ombudsman .Be happy...;)0

No maybe not GPEOL as I have seen some Napier car park signs where that won't work. That's why he needs to search and read other Napier cases and do a bit of digging and show us the signage and the car park t&cs (usually on a PDF link going by other Napier cases).PRIVATE 'PCN'? still doesnt explain how you get from a windscreen ticket to a popla code in one day
or that if he has a popla code he cannot afford to wait for an NTK in 29 to 56 days as a popla code expires after 28 days0 -
No, I think he just misunderstood the appeal isn't at POPLA stage yet...is it??Just received my appeal reply and I am still being fined!

The evidence being used against me is totally untrue.I returned to my car to find the ticket already issued.I returned at 13.50 and ticket issued at 13.33!
The 'free 1 hour ticket' that you displayed is only valid when you are shopping in either the Dunelm Store or B&M Store, if you not in one of those stores you cannot use the free ticket. You were seen to return to your car with shopping from another shop and therefore your ticket became invalid. The signs are very clear and state this, if required we will present our evidence to a court or assessor.
So they are saying I returned to the car with shopping then the fine was issued! Totally false statement from them!
Please slow down! Why did you send an appeal so quickly - it sounds like you may have even told them who was driving (despite the advice on this forum, eeek!).
If you rush your POPLA appeal like that you will lose. Hold your horses and read the advice already given. One minute you said you were waiting for the NTK and the next you tell us you've randomly fired off a hasty appeal and got a reply. POPLA code?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

B+M are usually tenants I would also explore if they the authority to offer consideration in contracts on behalf of the actual owner and convey this to a third party.Be happy...;)0

this thread was posted last night and post #7 says he has a popla form with code
that is the fastest I have ever seen it happen, when normally it would be between 14 days and say 75 days !! lol0 -
