I received correspondence from NCP today containing the case against me. At first I thought it was from POPLA because of the checklist at the beginning of the letter. This is sneaky because at first glance I thought that the appeal had been rejected.
NCP have included photographs of my car showing the ticket, the signage and the pay machine ( albeit a different one to which I used).
They are basing the case on the fact that the ticket , which was the only ticket the machine issued, is only a bank receipt. It does state that on the ticket, I have no idea why as I paid in cash. They are also stating that it has no expiry, which it doesn't but the ticket states clearly the time of purchase and the amount. This amount is clearly the same as the 24 hr fee as evidenced in their own photograph. Surely this is self defeating on their part?
I am now waiting on the ( hopefully) favourable decision from Popla.

Won the appeal. POPLA emailed today with the decision.
The appeal was won on the genuine pre estimate of loss. NCP did not defend this statement.

Reading the result, it sounds to me that NCP have admitted breaking the BPA code which states that damage must conform to the gpeol thingy. Perhaps more experience eyes would confirm if it is worth rubbing salt into the sound with a complaint to BPA and also Trading Standards (who don't seem to understand the problem at the moment but with enough complaints, backed up by appeal decisions should eventually be trained).0 -
I think well done is for everyone who helped me on this forum. Without their knowledge I wouldnt have been successful in this appeal.
It does concern me though, that if in future I need (not ever want) to use their car parks, the correct tickets will be issued by their machines. (This was the original problem where the machine issued me with what appeared to be a back receipt , when I paid in cash?!?!)

I presume that POPLA send a copy of this email or letter to NCP to state that they have ruled in my favour and that I should hear no more from them. Or do I have to send a copy to NCP?
