MET Parking Services

Hi all, happy new year to you.
I'm hoping for a bit of help out of a sticky situation. I received a windscreen PCN in the car park where I live on 4/11/13 for parking without a permit (it blew away in the wind!). I waited for the NTK which I received on 4/12/13 and wrote a soft appeal letter, which I posted on 20/12/13 but stupidly did not obtain a proof of postage receipt. I've written to the management company but I haven't heard anything. I received a letter from MET dated 30/12/13 stating that my letter was received on 24/12/13 and therefore the appeal time has expired, but had I appealed within the time limits, it is likely my appeal would have been unsuccessful as I did not display a valid permit- no mention of POPLA.
Im kicking myself for not obtaining proof of postage but im unsure whether to pursue the fact I posted it on the 20th though im aware it would be my word against theirs. Any help would be utterly appreciated.

    What was the actual date of the Notice to Keeper?

    it says "date of issue of this notice: 4/12/2013"

    So by their own admission they received your appeal 20 days after the date of the Notice to Keeper?

    Did they state in their NtK the period you could appeal? That's pretty irrelevant really as the BPA CoP Section 20.1.6 specifically states the keeper has 28 days to reply.

    I would write back to them, telling them you appealed within the 28 days allowed and that you expect a POPLA code by return or you will be referring their correspondence to the BPA.

    This happens all the time and you have grounds for complaint to the BPA as long as you appealed as the registered keeper and not implying who was driving of course (otherwise a poster throws away the point of waiting for the NTK). You need to search & read some threads, easy to find in the forum as described in the linked thread.

    You have appealed, they have admitted they received it, let them run out of time and issue them a served legal notice that the keeper discharges liability due to failure to adhere to POFA and issue a POPLA code in response to the appeal.

    Stop letting them make the rules up !

    You could do as Spacey says and let them run out of time for 'keeper liability' but if it were me and I was also the driver anyway, I would rather have a POPLA code.
