  • Thanks both! How about this amended version?

    Dear Excel,

As the registered keeper of (REG) I'm in receipt of your parking invoice (INVOICE)
    dated (DATE).

I wish to invoke your appeals process as all liability to yourcompany is denied on the following:

    1. Insaid PCN, you claim that the vehicle was parked without displaying a validticket/permit. Please provide myself with evidence that this was actually thecase, perhaps photographic proof of the vehicle being parked at the sitewithout a ticket/permit displayed.

    2. A ticket was definitelybought at the Peel Centre on 18/12/13, around 09:36am, but may not have thecorrect vehicle registration as it is possible that an incorrect number was enteredin the machine. I require you tothoroughly check the records of the machine that issues the parking tickets toascertain whether the licence plate details may have been entered into themachine incorrectly in error. I suspect you have overlooked a small typo suchas in the case highlighted on the BBC Consumer Scam/Rogue Trader ExposureProgramme, 'Watchdog Daily 'last year, where Excel's spokesperson assured thepublic:

''We do recognise that motorists may input an incorrect digit(s)of their VR number when purchasing a P&D ticket and as such our processingallows for a manual review/quality check of PCN’s before they are issued.Unfortunately, on this occasion our check failed to identify the...ticket.''

    3. I suggest that your manualcheck failed again in this case with my car.

    4. Show me your 'manualreview/quality check' records for that car park on that day, relating to thehour of arrival. If you will not show this to me then you will have to show itto POPLA anyway, where I will also require you to explain how the charge of £60is accumulated. There is no genuine loss that would account for anythingremotely close to this amount and the amount being claimed is not a genuinepre-estimate of loss to your company or the landowner.

    5. Your signage does not complywith the BPA Code of Practice.

    6. You are not the landownerand do not have the capacity to offer contracts or to bring a claim fortrespass.

These points and others will be raisedwith Popla should you not accept this appeal, and you will be expected toprovide a full breakdown of your alleged loss, and your full unredactedcontract with the landowner.

If you do reject the challenge and insist upon taking the matter further I mustinform you that I may claim my expenses from you. The expenses I may claim arenot exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when Iprevail.

Please issue your cancellation within 35 days of this letter, or forward aPopla verification code.

    Faithfully,

Bullets 2, 3 and 4 are actually all part of bullet 1's justification.
  • So maybe indent those as part of bullet 1, rather than seperate points?

Correct. And renumber the remaining bullets accordingly.
  • Thanks - will let everyone know how we get on!
