Excel Peel Centre

Hi all,

My wife had a PCN through the post from this lot saying she did not display a ticket. She did buy one, but trpically cannot find it. In terms of a response, ignoring seems no longer best, so would appreciate some advice on the response to Excel I have drafted based on posts I have seen.

Assume this would then potentially get me the POPLA code?

Dear Sir or Madam,

Re. your parking charge notice XYZ I can confirm I was the Keeper of thevehicle on the date of the alleged breach.

I am appealing against this charge since you have failed to provide

a) that your interest in the land is sufficient to offer contracts andparticularly that you are not just a trespasser.


b) that you have entered into a valid contract with the driver.


c) that you validly incorporated the terms that you are claiming give you theright to levy the charge.


d) that the charge is a genuine pre-estimate of your losses and not just anunenforceable penalty.

I thus expect you to cancel this charge immediately and confirm this inwriting.

Otherwise I am expecting you to provide me with the means to refer this matterto independent arbitration.

    As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to your company is denied on the following:

    1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner
    2) Your signage does not comply with the BPA Code of Practice
    3) You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass

    These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner.

    If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

    Please issue your cancellation within 35 days of this letter, or forward a popla verification code.

    but I would add something at the start mentioning that a ticket was definitely bought but may not have the correct reg number as possibly an incorrect version was put in the machine, ask them to recheck the ticket machine record for this at approximately 1213 (change the time here) as per their spokespersons words on the watchdog tv programme and as per the BPA CoP too

    its then put up or shut up with the ball in their court , but expect to go to popla with a better appeal, especially if you do not have the ticket receipt

    do not disclose any driver details or imply who was driving at this stage

    Either would do the job of getting the rejection & POPLA code! I agree with Redx that you should quote the 'Excel spokesperson' from a BBC consumer show, as this poster is:

    How about that sort of thing, as your wife must have made a typo and Excel must have failed with their manual check (if it even exists...!).

    clearly you have not read the sticky thread at the top of the page, about 4 down , where links are provided to successful popla appeals , including 2 for excel and the peel centre

    you can be doing this as soon as your appeal to excel goes off as you have up to 35 days to be constructing it

    help we will, but spoon feed ? no , I think not , lol

    so please read the sticky thread for NEWBIES , follow the links, learn the rules of the game and start on your popla appeal, posing a redacted version here for verification

    As previously suggested,avoid the queues and the charges by parking at big Tesco or park at Matalan which has a cheaper/better parking system.
    Feudal Britain needs land reform. 70% of the land is "owned" by 1 % of the population and at least 50% is unregistered (inherited by landed gentry). Thats why your slave box costs so much..

    totally agree,avoid the peel centre,then when all the stores takings drop they may then react to all the customer complaints about the scum known as excell,sadly most days the peel centre is rammed and excell are milking it to the maximum,especially with their anpr system,whereby unsuspecting motorists are are getting mega stung with postal pcns.incidentally i do not recommend you park around the corner at aldi,,,,,,say no more,,,parking spy are in full operation there with their scamming tactics,,agree tesco is the best option and just walk down the short road alongside b&m if have to shop in peel centre.

    Dear Excel,

    As the registered keeper of [REG] I'm in receipt of your parking invoice [NUMBER]
    dated [DATE].


    In said PCN, you claim that the vehiclewas parked without displaying a valid ticket/permit. Please provide myself withevidence that this was actually the case, perhaps photographic proof of thevehicle being parked at the site without a ticket/permit displayed

    A ticket was definitely bought at the Peel Centre on [DATE},around [TIME], but may not have the correct vehicle registration as it ispossible that an incorrect number was entered in the machine. I require you to thoroughly check the recordsof the machine that issues the parking tickets to ascertain whether the licenceplate details may have been entered into the machine incorrectly in error. Isuspect you have overlooked a small typo such as in the case highlighted on theBBC Consumer Scam/Rogue Trader Exposure Programme, 'Watchdog Daily 'last year,where Excel's spokesperson assured the public:


    ''We dorecognise that motorists may input an incorrect digit(s) of their VR numberwhen purchasing a P&D ticket and as such our processing allows for a manualreview/quality check of PCN’s before they are issued. Unfortunately, on thisoccasion our check failed to identify the...ticket.''


    I suggest that your manual check failed again in this case with mycar.


    Show me your 'manual review/quality check' records for that carpark on that day, relating to the hour of arrival. If you will not show this tome then you will have to show it to POPLA anyway, where I will also require youto explain how the charge of £60 is accumulated. There is no genuine loss thatwould account for anything remotely close to this amount.


    I wish to invoke your appeals process as all liability to yourcompany is denied on the following:

    You've mixed writing styles ... either they (your appeal points) ALL need to be bullets, or NONE of them are bullets. (I'd make them all bullets - your opening section is an appeal point).
