help!!

I was parked in a disabled bay today at Braehead in Glasgow. My blue badge was clearly displayed on my visor. On returning to my car, another motorist told me that I had just been given a ticket and the parking attendant had just left. I am a chronic asthmatic but managed to shout on him to come back to my car. I asked him what he was playing at giving me a ticket when blue badge was clearly displayed! He looked at my badge and said........oops!! I never seen it!!!!!
Just appeal, said this little jumped up Hitler....I told him he'd be better going into the shopping centre to specsavers as he obviously needed them!!
So what do I do? Photocopy my badge and submit it as he advised.... Or ignore?

    As it's in Scotland you can safely ignore for a variety of reasons. Relax and don't let it worry you.

    The Blue Badge regs don't apply in private car parks and Braehead has four different types of "disabled bay", none of which are legally compliant in any way, so you are at the mercy of whatever fantasy these predators choose to invent.

    So ignoring is the best way to get rid of them in Scotland - Expect a few months worth of scary letters that threaten more than they will ever deliver. Just file them for fututre reference and get-on with things.

    Your other option is to make a strong complaint to the Braehead management/management of all shops you visited, informing them of the PPC's behaviour and reminding that they have equal responsibility for the PPC's breach of the Equality Act - which is what governs accessible private parking. :)

    Braehead is wholly private - UKPC and no spaces are covered by the DPPPA, unless there has been a change in the last two weeks.

    If you have a look at the pre-POFA letter chain thread in this forum, you will get a reasonable idea of the rubbish UKPC and their fake debt collectors are going to send you over the next few months. However, if they do send you anything that refers to POFA or keeper liability, you can laugh harder as this only applies to England and no Scottish court will entertain it. :D

    UKPC are well known (including personal experience) for overlooking cars with blue badges when parked and issuing parking charges.

    Well worth making a strong complaint to Braehead management regarding their agents scandalous disability discrimination and breach of Equality Act - reminding them of course that they are jointly responsible. (if you feel up to it suggest that you feel you deserve compensation for the manner in which you've been treated as a genuine regular customer). Make sure that you word it so that it does not implicate that you were driving - eg word it as though you were a customer visiting in a vehicle etc. - we don't want the management contacting UKPC naming the driver.

    As the others have already pointed out there is no keeper liability in Scotland so it is important that no direct contact is made with UKPC - and their only option would be to pursue the driver if known.

    You could easily have saved yourself this grief by searching the forum for the single word 'Scotland' and read stuff like chickadee13's thread and MimosaDR's thread.

    Or read the 'newbies read this first' sticky info thread at the top of the forum where it tells you that it's safe to ignore fake PCNs in Scotland and gives you a Watchdog video to laugh at! The forum has the info you needed already here.
